benefits when partner is working

hi i have recently finished contribution based jobseekers after 6 months since being made redundant from a previous post.

my wife works and earns about 21k a year from this and we both live in the home which is in my name.

i have mortgage protection which is paying the mortgage at the moment.

neither of us is disabled and we have no children.

given all the above are there any benefits i can legitimately claim now that my contribution based jobseekers has run out?

    does the mortgage protection make a difference?

    my wife and i have been going through a bad patch recently, if we were to seperate and she moved out of the marital home, how would that affect matters?

    If you separated then you would be entitled to JSA income related (as long as you don't have excess capital). If you remained in the property you would start to get help towards your mortgage after 13 weeks of claiming IF the mortgage protection had ended. You would also be entitled to full council tax benefit if on JSA (IR)

    thank you. does this seperation need to be a legal one or is it just a question of notifying the benefits office?

    i am assuming there is no way we could be seperated and live in the same property with her paying me rent and for me to claim income based jsa and /or council tax relief?

    So basically as you cant claim any benefits you think by seperating you will be able to claim then but her still remaining in your joint home

    a) its not a joint home as it is solely in my name.

    and

    b) the question was is this possible? i know where you are coming from, but with regards to the question it doesnt answer it.

    'Splitting up' with your wife in order to claim benefits is fraud, yes.
