Yesterday I received a PPI rejection letter from RCI stating that my monthly payments did not include PPI payments, they advised that any PPI payments came out as a separate entity on your monthly bank statement, and as mine did not they are stating that I never had a PPI policy, this has made me upset and angry as I know 100% that I had PPI on 3 separate loans with RFS.

I am not sure what to do next, do I accept their decision or use a PPI claim management company and pay them a cut of any successful payment?

    Matt

You have already complained and been rejected - a claims firm cannot start a new complaint.

Please do not fall for the CMC lies and hype - they have ZERO special powers, ZERO extra weight, ZERO better chance - they cannot do ANYTHING AT ALL that you cannot do yourself.

All a CMC will do (assuming I haven't skimmed over you already doing this) is forward the complaint to the FOS (which costs nothing) and take a cut of any refund.

Out of interest, when you say you know you had PPI do you mean know as in you have statements proving that or just think you remember doing so? If you have statements why not simply show these to the firm?

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

I took out a loan with them as well for a Clio back in 2004. I'm sure I had PPI on my car
But I have no idea how to start the PPI Claim. The Renault dealer has closed as well.
I have since changed banks and I don't have any paperwork anymore (I've moved houses since)

Can anyone tell me what I can do to get this claim?

It is the dealer you complain to as they sold it. However, it is pre-regulation and the dealer is gone. So, you have no-one to complain to.

You could try the finance company as it is possible they had liability for the dealers but its a long shot.

Stick with it folks, I've recently received a letter and cheque for over £300 for my PPI issues from Renault Finance / RCI and that was without actually making a claim. So a big thank you to all who have gone before me for this.

I have found a PPI policy in the loft, however there is no mention of the monthly payments, I am going to send it off to RCI and hope they finally pay out?

On what basis do you propose to "sue" them? It is not wrong simply to have Payment Protection Insurance. You would need to demonstrate to the court that not only did you have a policy, but that it was mis-sold to you. You've already complained over eight months ago and been rejected, so court action seems an unwise and potentially expensive (for you) exercise.

That is likely to be too late to go to FOS. However, if the poster goes now and says theyhave found that the statement that there was no PPI they may find FOS sympathetic.
  • Hi no-loyalty. Do not be deterred....

I took out car finance in December 2004. I received an initial reply in July 2014 stating that RCI could not uphold the complaint as their ppi selling was robust and my policy included an unambiguous cancellation clause. I never received any policy documentation, only my finance agreement. I would have left it at that but then I received a further letter at the beginning of August asking me to resend a copy of the agreement (that they has incidentally sent a copy back to me and obviously already received) together with copies of bank statements covering the period in question showing the payments. All this information I sent to them; only for them then to send me another letter in September which was an exact replica of the first letter they sent. Clearly they have not looked into my complaint properly or acknowledged the fact that they requested the additional information from me in the first instance.

I have referred this to the FOS but as the policy was taken out 16 days prior to the ppi regulations they may not be able to help.

I am still on their case though.....
