I have no idea what the recruitment criteria is when the council employ a dog warden but I am guessing the bar is set pretty low. I am guessing the dog warden has a list of rules which anyone with an ounce of commonsense would have ignored in your situation. However this warden decided not to use his commonsense and release the the dog to your wife. The man is basically an idiot.
You probably want to ensure the dog can't get out again as people often go into other peoples gardens for perfectly harmless activities e.g. a kid going retrieve a ball back, a window cleaner etc. You don't want the dog getting out again as this could be expensive.
On a completely unrelated matter well done on getting a rescue dog, too many people are obsessed with getting pedegree puppies from breeders and neglect rescue dogs
Thankyou. The rescue centre had kept her a week longer than they were supposed to because she was such a lovely and well behaved animal they really didnt want to destroy her. But it got to 2 weeks and they ran out of time. Our initial plan was to just take her in briefly to stop her from being euthanised (we have 3 cats and never really wanted a dog) but after having her for 3-4 weeks while trying to find a good home for her we (mainly my wife) fell in love with her so we ended up keeping her.
Makes it even more annoying.. you do a good deed then get !!!!ed over in the process! Typical. All we want is to not get ripped off by the warden for unecessary kennel costs and for them not to "lose" our stuff.0 -
We don't even know that the dog escaped through the open gate - she may have got out before the gate was opened..
Our back garden has 6-7 foot panel fences all the way round. Only our cats can jump these, I cant see the dog doing this! Not unless shes read Steve McQueens autobiography!0 -

OP, I am presuming the dog's collar had a tag with your phone number on?
They can't charge you a £31 fee for a kennel stay if it didn't stay in the kennel!
Personally I would write to them with a cheque for £9. This is the £60 fine, minus the £31 that you shouldn't have had to pay, minus the £20 to replace the collar and tag that have been stolen whilst in the warden's care. If they do not accept this as a final payment, then you will have no option but to press charges for the theft of the collar.Should've = Should HAVE (not 'of')

Might be worth seeing if your council has any sort of written policy with regards to strays and how the dog wardens manage the situation. In your case, I'd be miffed about being charged the kennel fees when they were clearly uneccessary - certainly worth fighting. I think you're probably onto a loser with regards to the collar though, you may have to let that one go due to lack of evidence.
Just to let you know that not all councils have the same policy - I found a stray the other week which I took home while the dog warden came to collect it. In the meantime the owner reported it missing (escaped from the garden when a child left the gate open) so the warden just asked if it was ok for them to fetch the dog directly from me. No faffing around with kennels at all.All shall be well, and all shall be well, and all manner of things shall be well.

Conspiracy or not, a lot of dogs do mysteriously vanish from gated gardens only to be picked up by a dog warden who just happens to have been called by a neighbour, but for data reasons they can not tell you who that is .
Bull the dog wardens are on targets and you left them an easy one, they opened the gate and took the dog, the informant never existed, by loosing the collar they dont have to contact you in the first instance, they can run the bill up a bit.
No conspiracy.. it happens to lots of people, I caught them red handed trying it here last year , fiddling the gate, unfortunately my dog has serious a psychopathic tendency to drop the teddy and tail wag and shout off and possibly attack intruders and he alerted me to them, I think they had a lucky escape, never trust a spanner ! I ran out and the guy ran to a womans van (DCS) which the police say was registered to the councils approved contractor for dog services, the police said he made an excuse about finding the gate open, which is a lie as all the nearby chickens were correct and present, trust me if that gate was open and was just securing it, one would be missing in action. The police said there was not enough evidence, but he did comment that he did not believe the story one bit of the dog warden, which is just a private company and had officially warned them.
you dont need to lock the dog out, you need to lock the dog napping dog wardens out.

Well, if dog wardens are paid by private companies I can believe anything, frankly. I couldn't really see councils deliberately creating situations like these merely to profit from them. I don't deny there's corruption in council business, good God I live in supposedly one of the most corrupt boroughs in the country; rather that I believe corruption exists at a greater and more profitable level than trying to make an extra few thousand a month by nicking people's dogs.

Incase of further events, also for your own piece of mind pete , get a cctv camera set up covertly to record evidence...ie the garden and the house and the gate...once an 'officer' of the council or warden or laughingly named animal 'welfare' has it pointed out that he/she has been recorded in audio and visual they usually back down and start behaving, in my experience.....0
