  • time is dodgy though - how can you guarantee that the time on the camera is correct and not out by minutes (or even hours!)

    cameras do lose and gain time - they are not connected to an internet time server like your computer!

    You also need to check whether the times are quoted are BST or GMT. Some police devices are left on GMT all year round because changing them over twice a year would be such a nightmare.

    Also - as suggested, ask how and when the time is calibrated / updated.

    In most cases the time doesn't matter but in this case it's absolutely crucial.

    If you can sow enough doubt about the accuracy of the time, coupled with inconclusive photographic evidence, then reasonable doubt might be said to exist.

    Pic didn't arrive in todays post so still waiting to see what that shows.Hubby is now even more upset by it since the instructor says he has no recollection of it.Instructor also said if there was a red light that hubby was going to go through he would use dual controls..so why didn't he then???
    DH has asked me to call complaints and see what they say x

    Where in relation to your house (or wherever OH is picked up for his lesson) is the camera? roughly?

    He IS tough,only reason he asked me to call is he works 50/60 hours a week and was out on a business meeting all afternoon and I was at home :)

    Camera is approx 2.5 miles from home.Only problem is the instructor was late a lot so lessons over ran.

    We got the picture,and it's a very clear red light.Can't make out who's driving but you can just about make out a blurred figure in the passenger seat so there were two people in the car,travelling away from our house.

  • Just spoke to AA and the man was very vague,he's calling the instructor now.
    VERY amused to hear that hubby apparently drove last week though and has a lesson booked for 2mro morning..when he hasn't had a lesson for 4 weeks now and deffo doesn't have one tomorrow!!!:p

  • Well I hope you sort it out, it sounds like the Driving Instructor wasn't at fault either way if the photo shows somebody else in the car. It also sounds like the Instructor keeps a proper diary of his lessons, which he'd have to or he'd never know who was booked for when.

    SO i'd say it's proabably a genuine mistake to say that you OH was driving if in fact he wasn't, because he's not trying to cover his own backside if it was proven another person was (the student before or after), but he obviously had good reason to belive he was or why wouldn't he just give the other students name?

    What you might want to hope is that there actually was a student booked in right before and/or right after your OH on that day, because if not, and if your OH hasn't kept his diary (which the AA do provide to keep track of your lessons - my OH has one) to provide evidence to the contrary then it doesn't look good if I'm honest. The evidence would go strongly in favour of the prosecuting party.
