Notice of intended prosecution for learner driver.

Hubby is learning to drive and just got a letter of intended prosecution for running a red light :eek: It's from 9th July and he can't remember doing it but I'm assuming the have photographic evidence.
I'm a bit confused though.In a dual controlled car does the responsibility not also lie with the instructor?Surely if hubby was approaching a red he should have stopped him?Or not?Getting different answers wherever I look so thought I'd ask on here.
Just thinking about the effect 3 points will have on his insurance once he passes..was already going to be pretty high..grrrr!!!:mad:

To be honest I'm not sure who the responsibility lies with. I would ask for photographic evidence though, even if your husband hadn't noticed I'd have thought the instructor would have done. They could always make mistakes after all.0

I suspect that unfortunately OH was the driver so he is responsible.Feudal Britain needs land reform. 70% of the land is "owned" by 1 % of the population and at least 50% is unregistered (inherited by landed gentry). Thats why your slave box costs so much..0

I’d still want to see the photo.
As it was a driving school car the NIP will have gone to them first and it’s entirely possible they have made a mistake when they “fingered” your OH0 -
There was a thread on this a while back, but for speeding. The learner was facing points, and I think the driving instructors indemnity insurance picked it up. They were claiming for the inurance increase as well as all the other costs.0

Its possible that its not your OH its the driving instructor that run the red light either before or after the lesson. Request the photo as evidence one way or the other.0

surely you have a diary book of lessons taken with times?
i certainly would be making sure it was i that rather someone else because lets be honest how many times do instructors trouser lesson monies rather than declare their self employed earnings?
also as said you pay an instructor to stuct not sit there and pick his nose0 -
Yes I've heard stories before of driving instructors blaming a student to avoid getting points on their own licence.
Definitely ask for the photo evidence before admitting to the offence if the photo shows only one person in the car, especially a signwritten instructors car, then you are off scott free and your instructor is looking at a summons for perverting the course of justice. Might want to look for a new instructor too.
If there are two people in the car then it gets a lot harder, back in july did you store the exact time of your driving lesson e.g. in your mobile phone's calendar and does this coincide with the date/time specified on the NIP?0 -
They send the NIP to the registered keeper of the vehicle. Whoever is the registered keeper must have said your husband was driving at the time.
So yeah, ask for evidence to see whether he was driving or not.0 -
