    Defaults stay there for 6 years, then drop off.

    However, the default date has nothing to do with an accounts statute barred status, its the "cause of action" date thats important, the date you last paid, or acknowledged the account in writing.

    This can be difficult to determine with old bank accounts, as you dont make regular repayments, for the cause of action date you would need to see statements, the default date, again, can be difficult to determine, but should really be within 3-6 months of last use.

    The clock runs from the date of your last payment, not the date of default.

    The other entries on your report could be debts that have been sold on to debt buyers, who does it say owns them now ?

    The default date on credit report was Dec 2016. I haven't been anywhere near that bank account since 2001 though.

    Regarding the other two accounts showing up on my report however; one is for another old account that I closed back in 2007 and the other is for a Natwest credit card that racked up over £10000! I have never dealt with Natwest in my life.

    Both default dates show as 2012. I can only presume that they are the result of I.D. Fraud. I have raised disputes on my report for both of them.
  • After reading all this negativity about capquest, I delayed calling them, for 2 years. I wish I had done it sooner, they were very pleasant and helpful.....if you need to talk to them dont delay it
  • Hi, I've been getting phone calls from Capquest for a while now and have been ignoring them so far. They never leave a message but I've googled the number and it's definitely them.

    My question is this: I use ClearScore to monitor my credit rating, and my rating is pretty high and I don't get any warnings from them, so does that mean I don't have anything to worry about?

    It would depend on a number of factors.

    What the debt relates to, if it is indeed your debt, how old the debt is.
    If they want to contact you badly enough, eventually they will write to you, if/when that happens, respond with the "provit" letter.

    In the meantime check all three credit reference agencies to see if they are currently reporting any defaults.

    I would deeply appreciate any help you can give me. It concerns letters from Capquest.

    I asked for your help at the end of last year concerning letters from Capquest and Arrow Global. From advice given on the forum, I downloaded a template letter and sent it off recorded delivery. I thought that was the end of it.

    Bascially it concerns a loan I was supposed to have taken out with HSBC on the 12th February 2016. At that time i was 66, have never been to HSBC and was living on my pension.

    I said in my letter to them, would any bank give me a loan based on my financial circumstances, I really don't think so.

    They have sent me the original credit agreement and the amount shown is for £6714.25.

    My surname is unusual, and I notice on the agreement that it is for a person with the same name, who lives in a flat in Slaford in Manchester. On that date I was shopping in a Tesco store in N. Ireland, where I live.

    Also, on the statement for the alleged account, the person has used the card in a co-op food hall in Manchester on the 9th March. On the 10th March, I was shopping in Boots in the town where I live in N.Ireland.

    I am worried, and I can't help it, even though I know the loan is not mine.

    Can you please give me some advice to stop all this continuing. I was thinking of ringing them, but at the moment, when I am so angry, I don't want to

    It's taken a year to respond to your letter?

    I think you should respond politely stating the facts as you have told us. Don't phone them.

    Do you or the other person have a different middle name?

    You should probably check your credit reports with all three agencies. It's free now.

    My credit reports are okay and there are searches from Capquest. Nothing is linked to the address in Salford.

    From the documentation, supplied by Capquest, they just quote my first and last name. I never had a middlename. Should I just continue as you have suggested.

    Are Capquest just fishing because my name is not common and they are just trying to scare me. I needed to go to the doctor the last time that they sent me letters. It's silly, but I don't want to go through this again.

    So this isn't your debt and your credit files have not been affected.

    Now as regular readers will know it is really the creditor's responsibility to prove that this debt is yours. However you have evidence that this is not your debt. I think I would write pointing out that you have never lived in Salford, never had an HSBC card and that you were buying things in Northern Ireland at the same time as the card was being used in a Co-Op in Manchester.

    Suggest they go and find the other Avid Doglover.
