    I have done a quick letter, send recorded delivery, and keep a copy. Only send it if you really are willing to serve a summons, and if they respond after the summons has been served make sure they pay any costs incurred!!

    Dear Ms Ingram,

    Thank you for your response to my letter of xxx.

    Unfortunately, I am still not satisfied with your answer. For you to withhold £600 ostensibly because you have paid that amount over to third party suppliers yet not be able or willing to detail such payments is, I believe, unacceptable. For you to have done so when the original holiday was amended so far in advance, and was also changed to a more expensive trip, further compounds this.

    I have given you ample opportunity to address this issue and provide me with the requested details or a full refund of £600, but you have failed to do so.

    This is my last communication with you in an attempt to reach an amicable settlement of this issue. I feel I have been more than reasonable under the circumstances. Unless I hear from you with the required information for my consideration within seven days from the date of this letter it is my intention to pursue a claim for the return of the sum of £600 (plus interest) through the courts,

    I am reluctant to take this course of action but by your refusal to disclose the pertinent detail you leave me no alternative.

    I've just stumbled on this thread and whilst I wish you good luck it would perhaps be better to gain the advice of citizens advice rather than relying on well-intentioned but possibly uninformed forum respondants.

    Whilst you might have a possibility that the refusal to give you a breakdown will constitute a case for the small claims court you have now already put yourself in a tricky position if that route is applicable and a company with lawyers will not roll over.

    Unfortunately, using the phrase "Without Prejudice" is a favourite of many amateur legal eagles because it appears to give an air of officialness to what you send. However, the purpose of the phrase may render the contents of the letter inadmissible in court. It certainly should not have been used in your first letter as it possibly removes the chance of you using the letter as proof of an early attempt to be reasonable in the dispute.

    The time to use this phrase would only come later in the process when it is clear the parties are in dispute (it is not clear in this case yet) and one party is making an offer which is intended as full settlement without any admissions of blame or responsibility.

    Again, I hope you're lucky with this one. And I'll just point out that post from my own amateur legal knowledge gained from experience. I am not a lawyer.

    Two of my sons are lawyers and I have run this issue past them. All the comments made were in their opinions reasonable under the circumstances. Using the term "without predjudice" does not imply anything other than you are determined to get to he bottom of the issue, it is not a barrier to settling a case. I also have personal experience, both with this company, and with the SCC route.

    However, you are correct in that if the issue is serious you should take legal advice rather than rely on a forum.

    You know we have heard nothing at all, how rude!

    My mom is asking me to cancel and lose out because she doesn't want to give them anymore money and the balance is almost due :(

    I would ring them and ask to speak with Ms Ingram. Do you have a copy of the letter? and a recorded delivery slip? Maybe they are waiting to see if you will serve the SCC summons, my advice would be to do it, you have nothing to lose, they are probably calling your bluff.

    Won't be using them for any of my cruises unless very last minute and they are much cheaper than anyone else.

    They charge you £125pp even if the cruise line cancells the cruise
    Cancellation and Fees


    In any circumstance surrounding booking cancellation/amendments by the client, cruise line and / or tour operator, Planet Cruise will apply a cancellation fee of £125 per person + VAT to cover all administration expenses.

    Even when they have a cruise specialist who doesn't make your booking correctly, the reply you get is you have to pay the above charge if you want to cancel. Beware.
