    If it was me I would write back and say that as they cannot produce the evidence that the extra money has indeed been paid over to a third party you have no alternative but to conclude that they have retained it and you consider this punitive given the circumstances. Give them seven days to respond then definitely go ahead and file a case. If they cannot or will not give a breakdown that is unreasonable and I think any court would see that.

    With my issue they sent a letter like that back but when I wrote again, and was very firm and they did capitulate. My issue was for a much lower amount but I felt strongly about the issue and was not prepared to back down.
  • ABTA guidelines have never said pay your final balance 20 weeks before departure, that is outright lying. The longer they hold on to the money, the higher the risk ABTA has that they go bust and they have to pay out. I would report that, irrespective of all the other problems, to Consumer Affiars, ABTA, 30 Park Street, London SE1 9EQ

    I will try to get time to compose a letter tomorrow, but you should only mention court proceedings if you would definitely go down that route. So, you need to check with your mum that they want to see it through. You could speak for them if it goes as far as court (which imo is unlikely) but you do need to be prepared to do so if necessary.

    Well my mom wants her money back or they prove where it has gone, so yes she would be willing :)
