    If you haven't used your membership then you should definitely be entitled to a refund. Their site is full of vague and misleading terms, I don't think it'd be too difficult to get a refund because of this.
    If you keep on hassling them (though remaining polite) and mention legal action then your chances will be even better.

    Thanks. The first thing I did once they mentioned me not getting a refund was that I would "have to take it further" she replied saying that they could give me a refund less 28 quid cancellation fee. Not too happy about it but at least it isn't 120. I have still yet to receive the refund.

    you: I'm sorry but I find the email ziinga sent very misleading, and will be sending it to the advertising standards authority in order for it to be changed to one that clearly states the phone isn't free in the dictionary definition of the word.

    Did you do this at all? I think if a lot of people done they could maybe do something about it a lot quicker.
