Due diligence is one defence that may work for OOD SELs if they have only recently changed. Not likely to get very far on some that are several days overdue....
There are 2 parts to this - there is a procedure and the prodecure is followed.
From whats been said on this forum the main problem isn't that there is no procedure but that some stores do not have the management or staffing capacity to ensure the procedure is followed......
So due diligence may apply in some cases but there are quite a few instances where it doesn't

If R&R stops I think some staff will be as disappointed as us. Some of them seem to enjoy the race to remove wrong SELs before we get them and other seem to see it as a way to deal with their anger management issues (well they seem to always be up for a fight).
Last week I was in a store and someone was trying an R&R on some electric toothbrushes - it was clear that the SEL was for refill heads not the actual toothbrush. He took a photo with his cameraphone and stormed off for a refund.
When he went the staff seemed very happy about their 'win' and then proceeded to tell me that I could R&R if I 'ever managed to find' a misprice in their store! They told me that even a penny wrong would get my money back and the product free, but I'd have to find it first. Sure enough, never found any MSE R&Rs in there, just the ones I found by accident.
I also agree that R&R probably increases custom. I will go to Tescos for my shopping as it seems pointless to go there to find R&Rs and not get anything I need, even if it's just a paper and milk.0 -

Surely to use Due Diligence as a defence a store would actually have had to exercised Due Diligence in the first place.0 -

However earlier today I logged in it actually worked and didn't re-direct me - problem was that all mention of the R+R "IF YOU HAVE BEEN OVERCHARGED" bit had dissappeared. Nothing in it's place mind you but looks like a change is afoot...
if they are simply going to offer "refund the difference" they are going to be hit hard by trading standards...I know what Constantine is saying about taking action to prevent misprices but regular users of this site know that Tesco have left up misprices even after someone has got an R+R (This happened to me tonight!!!) and really is inexcusable - incomptence, laziness
perhaps but certainly not due diligence...
I don't want to see any company punished because I'm mean but I do believe that companies should be upfront about price and fair - unlike Leadhead I do actually care and personally it doesn't matter it is Tesco's, Comet or whoever I would report them to TS as matter of principle - these companies make millions (or billions) and if they are going to rip people off en-route then I for one am going to make a stand - who'll stand with me !?Tesco is my second home:j0 -

Potential Xbox360 R+R. I posted about this on the other thread a couple of days ago apologies for the repeat but I just want to clarify a couple of things and wondered if anyone could help.
There is one small shelf with about 6 360 premium DVD cases on it - only one of these cases has a picture of PES6 on the front but other than that it doesn't mention anything about the game or if it is a bundle. The shelf just has one white SEL of £279.99. So my question is... is this actually a 360/PES6 bundle and if so are they scanning at £299 now? The barcode is different to the barcode on the 'plain' premium cases.
If anyone can clear up that for me, obviously I would be quite a grateful little chap!

You could wait ages for an answer about this, and then it might only be a guess......I would go and buy it, if it scans at £279 or you don't get an RandR, either get a refund there and then or at another store, or if you feel you have a case, take it to HO.
