Neighbours complained, Landlord tells me i cant exercise in my own home...

nice attitude! you must be a sheer joy to live near. had you spoken to them or your LL about the smoke, rather than leaving a note guaranteed to get their backs up, i'd give sympathy. but instead you've handled it badly and want them to compromise while you make a really annoying noise that interferes with their lives.
it's not always about the principle, it's about how you go about things. but by all means keep backing yourself further into a corner without considered that YOU helped screw this up!
I am no child, i understand how to handle people so please don't lecture me about social etiquette. You do not posses all the facts so don't be so quick to make judgements. That's poor social etiquette right there. I think you're like most on the internet. You're just looking for an argument.
I HAVE told the landlord
I left a NOTE because it was the only way I could contact them (if you bothered to read)
I try to ignore the DOOR SLAMMING at 2:30am every night, which is annoying and wakes me up thereby interfering with my life and is detrimental to my health and job.
I ignored the ABSOLUTE TIP that they dumped in the front garden for as long as i could before i was forced to make a complaint.
If you quoted the whole thing you would see that my annoyance was not with the people downstairs per se, rather to point out the really abysmal view point you and many others have that has contributed to the slow decay of this country.

You need to get onto the council about the mess, you have taken pics, also you mention the neighbours are complaining about the mess, get them involved.
If the language barrier isnt a problem with the downstairs neighbours, couldnt you get one or two of them to come into your flat and hear the doors banging, and smell the smoke, then you could go down to thier flat get your girlfriend to run on the treadmill exactly like you do and see how bad the noise it.
Just another thought, if you can hear the doors banging it could be that they have heavy fire doors put in place, and if there is 6 of them living there they would need them, or is the 6 of them meant to be living there, could it be classed as over crowding? have a look into that, the LL could be breaking laws himself.0 -

Fully understood, i know i could be mistaken about the noise though i don't for the life of me see how it could be an unbearable intrusion or anything like that.
The fact that you don't see how it could be doesn't mean that it is not. I think what you're talking about seems perfectly reasonable as far as it goes but its all based on the assumption that "it can't really be that bad" for the people underneath and we just don't know that for sure.All i really want to know is:
is it enforceable by the landlord that i do not use it under both the T&C's i stated in post #28 (page 2)?
Not directly, the LL can't make you pinkie swear not to do it on pain of being thrown out on the street that day or anything, though he can opt to serve a s21 notice at the end of your AST. That may not be a bad thing judging by your other comments about the situation where you are now.
Note the points made by others - the neighbours can make a complaint about you being a noise nuisance to the council.am i being unreasonable in suggesting that i would only use it certain hours of the day so as to reduce the potential disturbance? e.g. 12-3pm or something like that
I wouldn't say it was unreasonable but then I don't know how noisy it is for the people downstairs.
All things considered, whatever you do in the meantime I'd be thinking about moving to a downstairs flat or house or whatever as soon as you could.If you don't stand for something, you'll fall for anything0 -
The LL can't make you stop exercising. However if he wants to he would just serve you notice to quit anyway. It's going to be important to try and maintain a good relationship with your landlord although it depends on how much of a problem the tenants downstairs decide to cause you - ie repeatedly complaining to your landlord, getting environmental health in etc etc.
It seems like this is not going to be resolved amicably if you can't contact the downstairs people to have a sensible conversation so really the options appear to be:
1) put up with it
2) complain to the relevant people - ie the fire brigade about the flooring/smoke issue, enivronmental health regarding the rubbish and hope that these resolve the issues and possibly the tenants move on or
3) move yourself and find somewher else.
It's not a great situation to be honest.

Thank you Df & Roberto both for some good constructive comments.
I have now spoken to my next door neighbours (the ones who complained about the mess in the front garden) about the fox/rodent issue. They have contacted EH. I said if need be i will put my complaint behind any investigation or argument etc.
I have spoken to my LL about the floorboards and smoke/fire/sound issue, i didn't mention the use of the treadmill because I'm not required to tell him if I'm going to use it and besides i think I've made my standpoint very clear so i don't see the need to bring it up again with him. He said he's going to look into the fire regs etc etc and sort something out within a weeks time, if nothing happens by then then I'll put it in writing just to be on the safe side.
We will definitely be moving at the 6month point and most definitely to a downstairs house/flat.
Any ideas as to what the rental market will be like in Dec? I've only ever moved around June/July.Deposit Saved £900/£25,000 3.6% :wall:0 -
This thread is utterly ridiculous!!
1) Of course you SHOULD be allowed to exercise in your own home. HOWEVER,
2) It's noisy and you need to think about other people that live there. Okay, so they may not be ideal tenants, but since when did two wrongs make a right? Either find a compromise or move elsewhere!
My dad has a running machine and for the 40 minutes that he's on it three times a week the entire house vibrates with every step. I don't think you realise just how loud they are until you hear it yourself. I've glad i don't live with my parents, i think that noise would force me out of the house whenever he was on it.saving up another deposit as we've lost all our equity.
