So is there a break clause at 6 months? Does it permit both parties to end the contract then, or just the tenant?
both, 2 months notice either way. We at this point intend to move out at the 6 months break. I don't want to live above these neighbours any longer than i have to. Im just slightly concerned as that takes us into dec which might be a funny time to move and find a place.Deposit Saved £900/£25,000 3.6% :wall:0 -
If you have smoke coming through from downstairs then ring the local firebrigade and ask them for advice.
I would say it means there is not adequate separation between the poroperties and if there was a fire downstairs you are at risk.
The fire brigade can come and do a check and fit you a decent smoke alarm. They might also investigate the issue with smoke coming from downstairs.
BUT I would give notice and move as well as doing this.0 -
oh come on. you live in a flat. there are people living below you. some common sense/courtesy would say that its not a good idea to have a treadmill above the ground floor!
(nuisance or annoyance is based on case law, so you'll have to do a bit of searching to find out more. in terms of different people having different thresholds for what is annoying and for what is a nuisance, case law states that it depends on the average person - look up 'the man on the Clapham omnibus).0 -

It'd indicate a poor quality conversion ... which the OP has also indicated by the poor quality fire proofing.0 -

As i said, I'm aware of the issues with it but its not unreasonable to use it at the least disruptive times as its my hobby. DIY is a noisy thing, my neighbour across the road works on his car and house making tons of noise but he does so at reasonable hours and its not for prolonged periods so i have no problem whatsoever with him doing so. I expect the same courtesy to be applied to me from all my neighbours as i would and gladly do do the same.England and Wales or Scotland?

I'd be secretly delighted that I'd found the ultimate weapon in infuriating the obnoxious neighbours, and bang away on the treadmill night and day. Probably the fastest way to getting fit ever.
Then I'd move and thank my lucky stars I don't have to sell the place.0 -

:rotfl: just had a picture of running over zealously on the treadmill with a great big caricature-esc grin on my face!Deposit Saved £900/£25,000 3.6% :wall:0 -
Okay I have to ask how does smoke come up through your floorboards from down stairs, are there no ceilings in the downstairs flat ?
A treadmill is a bad idea in a flat unless it is purpose built to a good standard.
Yours sounds like a criminally bad house conversion.
As for the other problems these are signs that it is time to move.0
