    Right where was I.
TS said that I have every right to pursue this as loss of bargain as long as I can prove I genuinly believed it was at a correct price, not a mistake.
If I knew it was a mistake and proceeded to get in their quick then I dont have a case.
I was also told that ebuyer can be done for misleading buyers but a judge will look on it as a genuine mistake especially as the price was so far out.

I was also told to contact newspapers etc so other people can be aware of ebuyer.

I was also told that it is possible to take them to court but was it worth it as it will probably go in suppliers favour irrespective of T+C.

And last of all contact ebuyer put your case across and see what they have to offer.

Wouldn't the fact that they used the words "Unbeatable Price" and "Amazing Bargain" go in our favour?. As at £28 it was an unbeatable price and an amazing bargain. Surely we can claim that this statement led us to believe its genuine?. At the £330 they are asking now they can't claim an "Unbeatable Price" because the very same set is cheaper than £330 at https://www.unbeatable.co.uk

Get in touch with Watchdog if you havent already the more we have the more we are likely to get noticed.

This company for too long has broken the law (look at all the bad feedback they get) so when they believe the law is on there side and that they havent done anything wrong, they now think they havent done anything wrong.

Pointed out above by shrek :) , and looking at that if it was a genuine mistake and a '0' was missed off it still wouldn't be "less than 330 Pounds" it would be "330 Pounds exactly!.

Taking action through Small Claims Court has been mentioned a few times. From my dim and distant recollection of going through that process myself, I believe that (A) you take 'action' against a named individual (e.g. the MD) rather than the company, and (B) you should have made reasonable efforts at dealing with the situation before going to court (i.e. get in touch with ebuyer MD first). So if, say 200 people, wrote individually to the MD (putting some of the well-reasoned arguments already posted in this thread) and stating that if the TV is not delivered as originally contracted, then you will take action in the Small Claims Court at Inverness/Plymouth/Aberdeen/Dover/ Newcastle/Birmingham (quote the name of your nearest court), and if such threats of action were made more or less at the same time across the country, then if only a dozen people actually pursued the action then the defendant (MD) would not have a cat in hell's chance of defending himeself (no solicitors allowed!). Furthermore, you could mention in your letter that your action would be for recovery of a sum of money equal to the difference between what you had already paid ebuyer and the £431 it would cost you to buy the equivalent model from your preferred supplier (Tesco). That way you would get your television thanks to ebuyer!

Slightly OT i know but if someone did take them to small claims court & they didnt win do you win the case by default ? Just curious thats all as i have no idea how these things work.

I think you win by default if the defendant fails to respond. Sounds like ebuyer would fit into this category most likely! PS if you do not win the case you lose the £30 odd and that is all.

But what if Ebuyer loose, and they don't pay. Then it will cost more money won't it. Love to see the Bailiffs go round :)

Think I have decided forget about this, sent my complaints off and will wait for any news however ebuyer have never been bothered about sticking to the law so I don't see why they will start. If trading standards say no (looks like they are saying we don't really have a strong case) then I think we should move on and find the next bargain! However if they change their mind and say we have a case I will fight for it.

shrek101 - I reckon it's about £35 extra to pay for bailifs. Yes, it would be fun :)
