Blueghost.
Dear Mr XXX,
Thank you for contacting our Support Team.
I apologise that your order has been cancelled due to incorrect pricing, however as per section 2.3 of our terms and conditions, we can cancel the order or give the option of reorder the item at the correct price.
We have followed protocol and we have not broken a contract.
I apologise for the inconvenience caused to you.
Please contact me again if I can assist you further.
Kind Regards,
XXX
Ebuyer Support
So what they are saying is that 'we cannot afford to supply at this price'
If you had an order in picking and asked to cancel as you cannot afford it you would get an answer saying 'No its a legally binding contract'.I thought that t&C's were supposed to be fair to both parties.
What we need is written proof of not allowing cancellation and they are S******D
Surely Trading standards would say that these were grossly unfair and hopefully insist on supply.Down south where, unfortunately, the government does remember us.0 -

It actually states that "If an error is found, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order"
As in offering you the option of cancelling the order, not them!
They really need to throw that shovel away...:)0 -
Has anyone got an answer out of trading standards yet?0

shrek101 wrote:Just spoken my credit card company. The money is allocated to Ebuyer but apparantly if Ebuyer don't go back to the CC within a few days the money is automatically re credited. However X amount has been taken of my available credit because of this.
Just had same response from Barclaycard. Basically if Ebuyer do not submit the voucher by 10th March the money is automatically recredited. If Ebuyer submit and subsequently refund the money then they have made a contract and I feel justified in pursuing it.
If you have paid by other means, whereby money is debited straight away, you may have a stronger case. I feel my case has probably just been lost but I'll keep checking just in case.0 -
No it is hasn't the funds are in the hands of an agent appointed by ebuyer. When you pay in a shop with a Credit Card the contract takes place at the till not when River Island or whoever get the money into their Bank Account.0

Trading standards have just rung me and gave me the low down but as I am just on my way out I wont be able to tell you yet what they said.
Basically the short of it is if you genuinly thought it was a bargain and it was not a mistake and you didnt think lets get in their quick before they realise then you have a case but as the TV should be £330 not £33 then it will be looked at in court as a mistake and it is on the suppliers side irrespective of terms.0 -
Can you people not get your head around this - THEY MADE A MISTAKE
the law allows for genuine mistakes to go unpunished -
I really really hope they next time you make a simple mistake (because thats all it was) that someone hounds you to the end of the earth for it.. you are pathetic...0 -

I take your point, maybe you made it a tad too strongly.... But i do feel that it was a mistake, it would be good if we could take advantage of it, but im certainly not going to hound someone over it.0 -

you pursue ebuyer till they are forced (unlikely) to honor the offer..they go into administration because of it..what about all the people that have outstanding transactions with them - those with orders placed and goods not yet despatched - those awaiting refunds - because of the stupid greedy and selfish actions of the grabbers the genuine customer will suffer....but then as selfish and stupid as most of the people involved here they wouldnt give a toss!0
