    I wouldn't say they are a ruthless company, terrible company with no regard for consumer protection laws or customer service I would agree with though.
    People are talking about screwing them over, well personally, considering the amount of people they have screwed over, the phrase what goes round, comes round springs to mind.
    To answer Vinny41's comment about folding tomorrow, then they are obviously in trouble now, and this fiasco won't make any difference, if not then it would be fraud.

    "There non public office number is 0870 4675030. This will get you through to an answer system. While the voice is talking, press 4, then hash, to bypass the system. This will take you to another message system, which asks you to spell the name of who you want.

    Press anything e.g. 115, then hash and it will fail to find the name you asked for, but it defaults to the nearest name. You are now in the system and you can toggle through their directory of names using the 1 or 3 buttons.

    If you want the directors, then listen out for Paul Cusack (MD), Steve Kaye, and Mike Naylor (Ebuyer customer services director).

    You can phone the accounts department direct on 0870 4675012 and always get a real person. Equally you can fax accounts on 0870 4675001"

    first mselurker and now vinny41 - where are these muppets coming from and perhaps they can go back!

    The problems are:
    • ebayer is flouting consumer protection laws AND is in breach of contract
    • their terms and conditions have obviously been designed by someone with no or little grasp of the law of contract
    • and redfox points out that there are even in breach of one of the regs of the Electronic Commerce (EC Directive) Regulations 2002 by failing to provide a contactable email address!
    With regards to the argument that the terms and conditions allow them to cancel the contract if there is a mistake in the contract then such a term is next to useless as it means the contract is only binding upon the purchaser and not them: that is not in fact a contract and is potential and unfair term. The whole terms and conditions are a joke and are such a mess. The situation is a fiasco - and i'm just hoping people kick up enough of a fuss that this gets some attention and costs them in terms of bad publicity and in terms of man-hours spent sorting the mess.

    My biggest problem is that they do this time and time again and get away with it each time. I hope someone does take the issue further and takes it to court because i'd love for them to be forced to learn from their mistake and pay the price for incompetence for once and for all.

    I'm trying to raise an Enote with ebuyer but cannot find anywhere on their website to do this. Appears the facility has been withdrawn or I'm just not looking hard enough. Any ideas?

    Unfortunately because it has not been tested in Law, cases like Kodak and Argos settled out of court - so there was no ruling to set a Precedent. Individuals can make claims for damages and monies owed in the Small Claims Court but taking the matter further so the Law can be clarified is prevented by the Cost to us.

    It suits most Companies to have this grey area so they continue to settle out of court then claim that it was goodwill on their part. My backside!
