Do the Banks pay up by cheque or not?

If the account is closed then the bank will most likely pay by cheque. Although in some circumstances they have been known to pay the reclaimed charges direct to the DCA.
Although if you get to the stage where you have commenced legal proceedings then if you win your case they can only repay you by cheque anyway.
Also, if they wish to settle outside of court, which 99% of the time they do, you can stipulate how you want refunding in order for you to drop the case.
So rather than paying off the balance on my card i can request a cheque to be sent to me by post... interesting0 -
im in the middle of taking the halifax to court for £2000 they have just acknowledged my claim im also taking halifax credit card to court and my credit card is over its limit and ive cut up my card i was wondering when i get my £1150 back from credit card will they send me a cheque or take it straight off my account if they take it straight off my account i wont see a penny of it can i request them to put it into my bank account?:T :beer:0

Hi, I recently sent off to Virgin credit card asking for a copy of all my charges to be sent to me. I recieved the list of charges today along with a letter saying that as a good will gesture they would refund £209.00 of the charges to me (they have taken £425.00 in charges off of me in total) The letter says that they have put it into my account, which i didnt want to happen because i owe them money.. Can i get that sent to me by cheque or is this to late now? What should i do now? Any advice would be great...0

I would adapt the first letter to advise them that you want all of your bank charges refunded but will accept the £209 as part payment.

TBH, I think they are fully justified in placing the money on tha account in reduction of your indebtedness to them. Your charges arose because you did not conduct your account properly, so why on earth should they not teduce their risk exposure to you, rather than sending you a cheque0

Another quick question, I am also waiting on a reply from the bank after having sent them the LBA, it has been 10 days now and i havent heard anything, whats the next step and can i request that in a cheque?0

I have to agree with oldwiring that if you have an open account/credit card the banks will pay the money into that account.0

Natwest sent me a check but wrote on it beside my name into account and my account number. i was paying it into that account anyway but apparently i could have paid it into another account regardless.0

next step is to fill in a county court claim form, n1 if handing it in or mcol if you want to do it online. and yes you can request a cheque.

They have 14days after the LBA to reply, if they havent done by the end of this deadline you can then file a county court claim against them, when you do dont forget to claim 8% interest on your charges. You can request a cheque if they offer you a settlement but from past experience if you have an account with them they will pay it directly to the account0
