A POC is particulars of claim - this is where you should have asked for cheques repayment. Highly uinlikel ytheu will just get rid off you - simple facts are that they owe you money and you owe them money - they are quite within their rights to offset this amount. You are not losing this money it is reducinmg your debt and therefore putting you back into the position you were before they charged you.
If you insist on going to court they are also within their rights to counterclaim what you owe.Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.0 -
Hi, I was talking to a girl on another site the other day who had this problem a few weeks ago with HSBC and DG Sols. She phoned the sols and told them that she already had an agreement for payment of the o/d etc and refused the offer of payment to go on to her Metropolitan Collection account and insisted on a cheque payment, they caved in and sent her the whole lot by cheque.
I went thru my statements yesterday and discovered that £700 of my debt to MCS relates to o/d on the current account I am claiming for. I faxed DG sols and told them I am happy for them to take payment for the £700 owed on the current account as the charges I am claiming for relate to this account but they must send the rest by cheque as the remainder of the debt has nothing to do with the current account its for a loan I had. I think this is a reasonable request, I am not after the money to spend on crap (well maybe just a bit!!) I want to be able to get rid of some of my debts so this way I get rid of one and am able to make extra payments on others I have and as its my money which they unlawfully took it should be my choice to spend how I wish.
In all, I think show them your not scared of them and if necessary you will go to court, its quite clear from reading other posts on this site banks don't wanna to that they'd rather settle.Remember ....its not a bargain unless you need it0 -
I am just about to file my Moneyclaim form against Abbey. I had an account with them for years and in the final stages got in to difficulty due to a poorly child. They refused to stop charging me, and refused a repayment plan and demanded that I close the account (which after much arguement and even more charges, I did).
The account was passed to a debt collectors and I am paying them back £1 a month at present.
What I want to know is, when I file the claim online, they obviously wouldn't be able to put the money they owe me in to a closed account, would they? Has the debt been 'sold' to the DC?
When i file my claim, can I request that they send me a cheque? That way I can approach the DC with an offer of settlement. I have had letters in the past from them asking if I wish to settle the account with 20% off the total balance and I don't see why I can't finally take them up on their offer, plus use whatever is left over so my husband can begin the moneyclaim process for his accounts.0 -
when i won against A&L they paid me by cheque. my account with them was still open and i had an overdraft. i spent the money immediately (wont do that again!!) then a few weeks later they stated that as i clearly dont agree with the terms and conditions of my account they were closing it and i had to immediatly pay back my overdraft. i dont remember actually stating i wanted a cheque ata ny point though.0

I too am in a similar situation and I require repayment of my Halifax bank charges directly to me by cheque. I will not accept repayment into my account.
I was advised that if I started a claim against Halifax through the County Court then the only form of repayment at this stage should be cheque, if a judgement is made.
Otherwise, if Halifax offer to settle out of Court then again due to being at the claim stage you can pretty much dictate how you want repayment.
I received this advice from various sources, but would love to get some further opinions and advice on this.

Bank of Scotland are paying me directly into my account which is currently with a DCA. I'm actually delighted about this as it will completely clear that account, get DCA off my back and also give me £1000 to pay other creditors.
Yes, you could try to insist they pay by cheque. My gut feeling is that they won't be too happy about this at all as obviously they'd rather you use the money to discharge any monies owing to them. I've had a bit of a ding dong with Nationwide over my wifes refund. We were at the court stage when they made an ofer and they even refunded the charges. I politely phoned them and said I wanted a cheque. They refused and I said fine, I'll continue with the court action.
30 mins later they ring again. They'll give me a cheque but the account will be closed (it was anyway)
Insist on a cheque. If the account has been moved to a debt collection agency (like my wifes) you can often ring them once you have payment and pay off your debt in a lump sum. They'll give you a discount on the bebt to boot (usually 30% but often more)
It pays off your debt and saves you money :T0 -
ok im just about to ask for my 6 years worth of statements from the hsbc, this is my old account and is now one of my creditors, i owe them 2.5 k for an overdraft,
my question is ,,,if i was to get some money back from the hsbc will the put it into the hsbc account or will they send me a cheque for my new account??
