Do the Banks pay up by cheque or not?

  • If you still have a debt with them, then yes they are likely to pay this into the account that has the debt.

    i had a debt with natwest and as the account is not closed the debt will go in there. this is because the bank state that they are not giving you a refund its a gesture of goodwill! so i have agreed to do this as it means that my natwest loan and overdraft have been paid off and my account will then be closed!! no more natwest (apart from the credit card) and i will have about £300 as well left over which will cover my council tax arrears!

    If you ask for the charges to be returned on your POC (Particulars of Claim) by cheque then surely if the bank wishes to settle out of court then it is entirely upto the claimant on how they wish to be paid.

    This is the line of advice I have been receiving from other forums.

    Does anyone have any direct experience of asking the bank to pay by cheque, in doing so going against the banks wishes of repayment into an account?
  • I have recently been offered £4,425 from Nat West for unfair charges. They are saying the repaid charges must be credited to my account. I currently owe Nat West £10000 for which I am paying back monthly. They are saying the refund of charges must reduce this debt whereas I would like the £4,425 paid into a different bank account. Does anyone know what the rules on this ?
  • What is the 10k for?
    as you have managed to get £4k in charges in the first place, i am assuming this may be some sort of unauthorised borrowing, in which case they are well within their rights to ask for this to be paid off!
  • The 10k was a combination of both an overdraft and a loan which they took court action for as I was unable to meet payments. An agreement has been made for me to pay this monthly. The monthly payments are fairly affordable so I would rather have the money paid into a different account.

    I have gone through the whole process of claiming back bank charges from BOS. I took them to court through money claim online and won by default on 3rd Feb. I received a letter from the bank offering an out of court settlement in full including court costs on the 8th Feb. The money was paid into an account that i no longer have access to as it is enquiry only without me agreeing to this. I phoned the bank on 9th Feb and asked them to pay me by cheque and they told me it was the banks policy to refund the charges into the account they had been applied to. I would prefer to be paid in cheque as I have more important debt ie rent arrears, to pay. i understood that this was my money and it is my perogative which debt i pay off first. What can i do? Can i refuse this offer and apply for the warrant through the court? Any ideas welcome.

  • First off, thanks for the great tip and stories from all which has seen my claim for just under £1000 (without interest) leading me to receive an offer from the bank of £500 in a little over 3 weeks since my initial letter.

    I'm accepting - but my question is this:

    I'm overdrawn at this bank (I have a new bank account elsewhere) - so will my old bank simply credit that account? Could I not ask for a cheque? I'd like to annotate the signed acceptance letter with that request!

    It would be nice to have the cash at hand - but if it reduces my debt with them then fair enough. It's just that I've recently filed with a debt company to handle my hordes of creditors as I seek to escape from this mire. In fact they've only just got in touch with my bank - who will have noticed they didn't receive my salary this month ... so I'm lucky to have got their offer.

    I'll post the full success details when the money has indeed passed over to me - sigh ... I almost enjoyed wading through bags of stored statements from the loft lol

    Any comments? I'll then be willing to let this thread slide into the archives :D
