Do the Banks pay up by cheque or not?

  • As I said in my original post..... I was after info on wether the Abbey could open up a new account in my partners name( after closing the previous one) without actually notifying her - ie: Abbey opened a bank account that until now she had no knowledge of - thus opening her up/ exposing her to id cloning as she would never have known about the account!

    Also, there is a seperate payment plan setup for the funds outstanding whilst she is trying to get her money back, this was offered by her on the understanding that if her claim was successful then any monies would be repaid to her along with her charges.

    MAYBE? I wasn't clear in my original post.... the £2500 that you ask "why the heck wouldn't they offset it".... IS ALL IN CHARGES-THEY'RE IS NO DEBT ON THE ACCOUNT APPART FROM THE £35 FOR STOPPED CHEQUES( normaly £1-3 short) OR THE OVERDRAWN FEE OF £25( for normally being £5 overdrawn). The amount is so high due to Abbeys unwilling, and pig-headedness not to reverse charges for stupid amounts,which spiralled in the end to the stupid amount above! I accept that people should manage they're money but £35 for a cheque which was cashed when the account was as little as £0.87p - have a word - I have spent a great deal of time going through her statements etc to collate the info, and @ times even gone to the abbey with her to try & get these 'idiotic' charges removed-but greedyness on Abbeys part prevailed @ all times.

    As I said in my earlier post... Anyone with any HELPFUL advice, rather than non-helpful advice from those who haven't read the post properly - would be greatly appreciated

    Hi

    My last Statement states that my Balance with Capital One is £257.30.But this is all charges that have been applied as I have not taken any money out for ages.

    Will they say that I owe them this?

    Ive read that the money you are claiming will go into your account & not by cheque,is this right?

    If so,surely its going to take £257.30 off my account which their gonna say I owe them as this is my Balance?

    Also if the total amount Im claiming does go into my account which is £1,272 its going to show that this is now my Balance & that I now owe them this :confused: .

    Maybe Ive got it wrong as Im now getting tired of all this & not thinking straight (dopey draws :rolleyes: ).

    I am claiming against my old bank, Allied Irish.I left them 3yrs ago. Their office dealing with my claim is in Belfast. Do I need to register my small claim in the Belfast courts or here in Yorkshire where I live.?

    ive just sent my request for payment back of my last 6 yrs charges with HSBC. I have two accounts with them, one is a basic bank account with no overdraft, and this is the one that has incurred all the charges. Then i have a managed loan with them, which is a totally different account and is paid on a monthly basis from my basic account, ive never defaulted on any payments, so am i right in assuming that they will credit my basic bank account with any charges they do refund??
    Surely they cant pay it into a different account can they?? id prefer to carry on with the monthly payments and use the money to pay off other debts which are behind, whereas this one is not??
    Any ideas anyone?

    I have no knowledge of whether Abbey can open a differenct account etc. But I have to agree on the charges front with MarkyMark D. Personally i would go back to them and demand the full amount of charges you are claiming. After that, then Abbey really do have the right to offset your gf's debt with this payment. Her account wouldn't of been overdrawn if it wasn't for these charges, so when they are returned then they should go towards paying this debt off. Imagine if the charges had never been put on, and you never claimed them back. In an ideal world your bank account would have a balance of zero. Abbey paying you back your charges, should correct this. You never really owned this money, its not from a fund you have managed to top up, its actually made you overdrawn, so you owe the bank that money.Why wouldn't you want to get rid of the debt anyway? Good luck, I hope you get the rest of what your claiming

    I wonder if anybody is in the same position as me, I have been trying to claim my bank charges back from abbey and natwest, have got an offer but they wont send me a cheque as Im overdrawn. I asked a legal team to help thinking they had more weight behind them but they were useless told me to accept what they were saying and also abbey said would only pay out a third of what I asked for.
    If I go the financial ombudsman will they be able to help any more? :rolleyes:

    Looking forward to your comments as I'm fed up up now with this its going on too long

    As you can see, you can ask for a cheque but generally the bank will pay any monies reclaimed into the account that has been claimed from and hence this will reduce the overdraft.

    Also if the account is closed and there is a debt on the account they are likely to open the account to put the money in the account to clear any debt.

    The FO is likely to agree with the bank.
  • Taken Cap 1 right through to online claim which they were defending. Time is up on 5th July.

    Had a letter saying to resolve the matter they were refunding total claim of £1216.90 but were paying it to my old account which I havent used for the last two years.

    I had stated I wanted the refund charges paid to me by cheque and written to them saying I am not satisfied with them paying the monies to the account.

    Can I hold out and continue with the claim and force them to pay me direct. Call me controlling but they took the money from me unlawfully and I feel I should have the say where the money goes, especially as this includes refund of my court fees.

    Anyone had similar and how have they and Cap 1 dealt with it.

    Hi, my bank account was closed by the Bank and my debt passed on to a collection agency where i am making monthly payments! Will the Bank open my account and pay the money in (if i win) and then close it again with my remaining money or will i recieve it all?:confused:
