You can ask for a cheque but if there is a debt on the account they will pay any monies reclaimed into that account.0

Hi There, i was wondering if anyone here can offer me any advice.
I am currently paying a collection company monthly payments for an overdrawn ammount on my Nat West Account and have just discovered that the acount will remain open until the debt is clear.
Here's the problem, Nat West have agreed to pay me £200 in bank charges but they will be payed into my account which of course will just absord the money.
Is there anyway i can insist that they send me a cheque, is there any way round this.
The overdrawn ammount occured when a private arrangement with a standing order i had with someone was canceled without my knowledge and i withdrew the funds which were then pulled from my account leaving the overdraft. The money i with drew was then used to pay the persons rent/bills ect (long story) there is no way i am ever going to get this money bac from them (another long story)
Any information anyone can give me on how i can make Nat West send me a cheque would be so much appreciated. Bahhh i feel like i have been double whammy cheated. Gutted0 -
If there is an outstanding debt with the bank involved, regulated by the same contract (ie. not a loan or credit card), then the bank can, and will, offset any moneys reclaimed against that debt. The acquisition of wealth is no longer the driving force in my life.0

Hi, I am claiming my charges back from beneficial bank, got an offer and am going to accept it, no longer have a credit card and only have about £80 left to pay on the card, the problem is the letter I got from beneficial says the amount will be credited to my account, can I ask them to sent a cheque rather than have it paid into the account.0

They will probably take the £80 off that you owe on your card and send a cheque for the rest.
Maybe call them and ask them to forward the balance by cheque, I think they are legally entitled to take what you owe them first.:D0 -
Thanks for that reply, hopefully thats what they shall do, Im claiming for about £1000 and they have offered £550 which I am going to accept.0

If there is an outstanding debt on the account you are claiming on, the bank or credit card company involved can and will offset any monies reclaimed against that debt.
Pity about the £450, though. I wish I could afford to lose that much. The acquisition of wealth is no longer the driving force in my life.0 -
Please can anyone help me?
I have had a letter from Natwest stating how much they are willing to pay back regarding unlawful charges but they want to pay in direct into my account. I have asked them nicely if they can send it in the way of a cheque but their reply was that any money reclaimed would be offset against the debt i have with them (i defaulted on a loan with them).
Is there anway atall that i can get this money sent in cheque form so they don't take it off me again or am i resigned to never seeing it ever?
Please help me!!0 -
If you owe them money, it has to be repaid somehow anyway, and they are entitled to offset money they give you against money you owe them.Reclaimed thanks to this site:
