Do the Banks pay up by cheque or not?

    Can anyone help me? This is my 1st time on a forum so please excuse me if i sound a bit dense!!

    I started my claim for bank charges from HSBC back in February. I asked for a refund of £2853.42 (interst included). I finally received a reply today offering me £1880, but they want to use it to pay some of an existing debt with them. Can the bank do this or do I have the right to expect them to send the check to me to use the money (theoretically mine in the 1st place!) as I see fit, i.e paying other smaller debts (OOPS!). I would appreciate any thoughts on this. Thanks

    yes they can do this...the have the right to offset any claim if you owe a debt..bit like me really...am claiming for well by time it gets to judgement about £3000, they have paid a goof gesture of £750 I still owe after that about £343 so if i win my claim of £3000 then £1093 isnt mine, hey ho...

  • I am about to start court proceedings against Barclays. when I started this process I was over drawn and they closed my account so it is at present in a state of limbo. If they do repay my charges will they put the money into my account ( to clear the over draft) or can I request a cheque payment. any advice would be helpful thanks

    Hi Graham
    If you owe them money they will take it back BEFOR they pay you anything back.

  • About a year ago my job changed and I was not on the same wage. When First Direct spotted this drop in salary they cancelled my account and moved my overdraft into an agreement - not a loan - where I would pay back a certain amount each month. As with the majority of people the main reason that I was so overdrawn was down to the fact that they had wacked on a hell of a lot of charges for direct debits being taken out on the wrong day etc.

    I've recently claimed the money back about 2.5k however I want them to pay it into my new bank account and not inito the first direct account that they closed on me. When I instructed them to do this they told me that this was not permitted and that the money had to be paid into the first direct bank account. I explained again that they had closed this account however they still say no

    Can someone tell me if I have the right to tell them that I want the money paid into a bank account of my choosing and not theirs please.

    I too had a refund from First Direct, however it was an old account and they told us it was not actually closed as it was needed to pay the mortgage through.

    They then arranged to pay the amount into that account and we could withdraw at another branch. However, from new experiences it does seem normal procedure if there is a balance outstanding to pay this money into that account first to clear the debt.

    So good luck - you can but ask!

    hi-i still have joint account though i have been separated for 4 yrs-just as i started the reclaiming process,my ex husband started an iva so r.b.o.s put a "no operations" on joint account! im claiming for last 6 yrs and have recently received an offer-only problem is bank says they will put the money back into the joint account-which means i will lose it to the iva (which is not my debt)-can i demand they pay me by cheque or am i basically stuck? thank you to anyone who can help or advise me :confused:
  • As al has said, i think it is joint and several liability so if the charges are on the joint account then, yes they are legally entitled to do so.

  • HI There was wondering if someone can help me please . I have been following martins step by step guide to reclaimimg bank charges from lloyds for my sister and am now on to the third letter so hopefully should be getting something back pretty soon . The thing is my sister has money owing to them on her account all the bank charges put her in this position in the first place so she dosnt really want the money put straight back into her account as they will take money off her which she will be reclaiming anyway ,can she request them to pay her by cheque or into a different account any replies would be most helpful as im kinda new to all this. thanks in advance !
  • The money was taken by the bank from her account so the bank would be reducing her debt. If she wants a cheque and the bank have not paid within your deadline then you would have to sue the bank for a cheque to be issued.
