Do the Banks pay up by cheque or not?

    They may have tried to open a normal account for you.

    Your bank will have a right of set-off between all accounts you hold with them. So they will probably credit the refund to your current account and then use it to clear your loan arrears.

    Why would you possibly expect anything else to happen?

    Closing your current account won't make any difference. They can credit the refund directly to your loan arrears if they want to.

    im in the middle of taking the halifax to court for £2000 they have just acknowledged my claim im also taking halifax credit card to court and my credit card is over its limit and ive cut up my card i was wondering when i get my £1150 back from credit card will they send me a cheque or take it straight off my account if they take it straight off my account i wont see a penny of it can i request them to put it into my bank account?:T :beer:

    I'm in the exact same situation so in all my letters to Halifax I stated that I wanted a cheque.

    Haven't heard back yet (they have until Tuesday) but I'm hoping for a cheque otherwise I wont see any of it either!

    I would never have gone OD if not for the charges, got a feeling will lose out :(

    I was claiming back £740 from Halifax Credit Card (my limit was 1000 and I'd gone 740.00 over that.

    They wrote back today offering £350 BUT are only offering to pay it into my closed account to pay some of the money off.

    I am and have been on income support all this time and desperately want the money for myself and did state this in all my letters.

    My question is: Can I insist in a personal cheque?

    No, you can ask but if there is a debt on the account they will use any monies reclaimed towards that.

    The bank actually passed my debt to an agency and I am paying off £1.00 a month (as with all my other debts).

    I would not have gone overdrawn had it not been for these charges.

    I currently have an electric bill for £300 which I would like to pay off with this money. Is there any way I can prove hardship in order to get the cheque sent to me?

    If they dont agree to this I feel its been a total waste of time :(

    If the charge refund clears your debt, then the bank will presumably buy it back off the agency and you'll save your £1 a month.

    I don't see any reason why they should give you cash.
  • My account is overdrawn, on an agreed overdraft, which is being paid back so much a month, Lloyds paid in some of the refund (confirmed I would be getting it in two parts with there solicitor.... don't ask!) and I asked if I could withdraw it, and went down the bank, and withdrew £700, no questions were asked or anything? Is that because it is an agreed overdraft. I am hoping there will be no issues when they pay the other half in either as I want to use the money some where else and as I have already agreed how much and when I will pay back Lloyds etc.

    Don't they give you notice if they are going to change your overdraft limit or if it is going to be reviewed?

    I have a RBOS account which has now gone into default for various reasons (I am taking my employers to tribunal and am currently on Incapacity Benefit so have fallen behind with my mortgage). I am dealing with the RBOS credit control department down south about repayment. The account is only valid for paying in money but I have no access to it. My current account overdraft and mortage have been combined into a main account that I have no access to.

    The RBOS eventually sent me a goodwill offer of £1055 (original amount asked for £1900 without interest). Because I am in a desperate financial situation, I have decided to accept it (I haven't sent the form back to them yet). While I was waiting for my 'goodwill offer' letter, I called the help centre several times and was told at least twice that I could be sent a cheque or the money will be paid into another account.

    When I received my offer and phoned up to confirm the above, I was told by a horrible patronising man that the RBOS had a 'right' to this money and it would get paid into my default account; therefore I wouldn't see a penny of it.

    I wrote a very strong letter about this, detailing that these unfair charges were taken from my account without my consent. Therefore the money is 'mine' and no-one else has a right to it. I received a brief snotty reply stating that the account is technically 'open' so the money must go into it.

    This is such a rip off. I really need the money and it has to be swallowed up by my default account. Please, does any one have any advice for what to do next? Thanks so much

    lolly hun..if you owe money to them they can offset against you any amount you owe.
