    I don't know if any of this helps, but i'm kinda at the same stage as you. Time Barred Welcome loans, although I have 3. I wrote to Direct Group, and Charlotte gave me alot of help, as she told me I also had Health Care on all 3, so that would give me 6 cases!! She advised me to write to Aviva telling them i've been mis-sold. That was around 10 days ago, today, I've got a bulky letter back from Aviva, that 'without admission to liability' would I send back the 6 FOS questionairres within 14 days, and they would look into my complaints with 8 weeks.

    Not what I expected, but to be honest, I'm thinking of sending this to the FOS within 2 or 3 weeks, as it takes them 4 weeks to even look at your case, so I hope that would speed this up (considering it's took 7 weeks to get THIS FAR!!!)

    Do you have the address for Aviva that you wrote to?

    I havent had time to call the FOS back yet, but they did say that they would not look in to welcome or direct from that long ago as neither of them were regulated; so as amersall has suggested to chase Aviva.

    Greateful if you have the correct address, and will keep eveyone posted on the replies etc,

    So, if the FOS won't look at this, what happens WHEN aviva deny liability (and they will), what's next?

  • Hang on a minute. I've been looking around and someone got a payout after re-submitting a claim via FOS after adding that Welcome werent regulated by FSA, but they WERE regulated by GISC. This guy got paid out after that!!
  • I cannot decide what the next move should be as I cant find a case with someone in the same situation that has been successful.

    1) Do I threaten WF with court action
    2) Do I pass to a claim company to try no win no fee (not that I want to)

    Not called FOS yet to ask about aviva and likelyhood of success,

    But if WF did not conform to GISC and aviva did; then is this a case for having the whole loan + PPI refunded or have I mis-read something?

    I have a wf policy (paid off) from 2004 which the claim company I used said it fell outside their guidelines and they would not proceed with the claim via FSCS and closed the file! I am now going to try to proceed with it myself by first writing to welcome and seeing where that gets me as this definitely was mis sold! I am not feeling very hopeful though but think it's worth a shot! Please keep us updated with how you get on with yours and good luck, welcome finance are the worst company I have ever dealt with!

    Been a while and so darn busy at work the days just fly by.
    Since I have heard sod all from Welcome about this I am going to try the direct hard approach.

    I have written a letter with a copy of the complaint, my statements and the letter from Direct Group; based on the figures from the FOS refunds thread I am demanding that they respond to my complaint within 10 days from tomorrow and if not i will start legal proceedings! :T

    I have also detailed the amount I want refunding and requested a reply with their decision.

  • I've had a reply from welcome to the letter that direct group sent them in AUG, its a massive NO!!!

    But they have sent a FOS leaflet LOL, so I gave them a ring and have started a claim against AIVA who have 8 weeks to give me an answer.

    Not much movement so far, but I will keep you updated.

  • Well its been a while, quite a while but here is my update.

    Complained to FOS about AVIVA, who worte to me asking for me to explain my reason for missale etc including a copy of everything!

    Aviva wrote back saying go away, you were eligable for the insurance and so they decided to uphold the sale of PPI! :mad:

    After this depressing news I chucked the letter in the drawer, but found it again last week and realised they had not addressed the reasoning behind my complaint.

    I had complained about the way it was sold to me by WFS, and that it was compulsory nor would I get the loan without the PPI. So I called up the FOS again and told them of the news, filled out the official FOS complaint form and a copy of EVERYTHING!!!

    They had also asked AVIVA to explain themselves for this reason and stated the FOS held them responsible.

    Hopefully now they will investigate and force AVIVA to pay if found to be guilty, if thats how it works; anyway Im crossing everything as the FOS were not happy either.
