Hi Dex,they have 14 days to respond to you, this is up today,it wont hurt to give Welcome a ring to ask why it has been passed back to them and what is happenning.

I sent a detailed email last night with all the dates asking for an explanation so I may well give them 24 hours to reply and then call them up tomorrow lunch time.

    Thanks,

Just called up the WFSL FSCS line to be told that anything prior to 2003 would not be considered as its "time barred" LOL

So I just called up the FOS and neither Welcome or Direct Group were regulated at the time (20.08.2001 PPI purchase date)

Now I feel I will not get anything back as I can complain and shout but from what I've been told they do not have to give me a penny,

    Or

Do I now write a letter and enclose a copy of the questionnaire demanding my money back (now I have the calculations!!) and threaten them with legal action?

    Thank you, I'm gutted.....

The only thing I can think of looking around the guide is now to threaten them with a letter detailing the amount including interest that I will be taking them to the small claims court?? something I know nothing about!!

Do you know if there is a template to this effect?

Hi there, i am back :D have trawled this site and have found something helpful, the insurance people you wrote to had the insurance underwritten by Aviva/Norwich union.
We need to find out the address for these.

Give FOS a ring and ask if they have the details for the underwriter and ask if you put a complaint into them, can the FOS help you if they come back with a no.
The underwriter will have been registered when you took the loan.

    Worth a phonecall?.
Give it a go and see what they say.

    Thank you soooo much....

When I spoke with the FOS they said that Direct Group were not regulated until JAN 2001, and my policy started in AUG 2000.

    Is the underwriter different again?

I looked on the "claims not covered by FOS" thread.
Someone with Welcome had direct group and said the underwriters were Aviva/Norwich union.

The FOS helped them after they put a claim in,the only thing is...the poster did not update what the outcome was!!!.
Still,it is worth a go,ask FOS if it is worth pursuing the underwriter and do they have an address for them.

Di would be able to help us with this i am sure,i will make sure she has a look at this and see what she has to say.

You have nothing to lose at this stage and all it will cost you is a phone call and a recorded letter.

Great OK I will call the FOS again tomorrow and see what they say; do I understand correctly that because they "underwrite" the PPI then they endorse the selling of it? and this is my reasoning for chasing.

Also I have yet not had a response from welcome...they may yet suprise me...HAHAHAHA, :rotfl:

You may very well get a reply from Welcome :D;),the way you describe the underwriters is what i think too,but i am sure others would disagree.

You are going for the underwriter because your loan was 2001 and hope that this is a route you can go down.

Good luck and i hope you are able to go this way.

Catch you later. Lorraine has left the building :rotfl::rotfl:
    goodnight :D
  • Hi,

I don't know if any of this helps, but i'm kinda at the same stage as you. Time Barred Welcome loans, although I have 3. I wrote to Direct Group, and Charlotte gave me alot of help, as she told me I also had Health Care on all 3, so that would give me 6 cases!! She advised me to write to Aviva telling them i've been mis-sold. That was around 10 days ago, today, I've got a bulky letter back from Aviva, that 'without admission to liability' would I send back the 6 FOS questionairres within 14 days, and they would look into my complaints with 8 weeks.

Not what I expected, but to be honest, I'm thinking of sending this to the FOS within 2 or 3 weeks, as it takes them 4 weeks to even look at your case, so I hope that would speed this up (considering it's took 7 weeks to get THIS FAR!!!)

    Hope that helps a little..
