The court ruled in my favour against Amex last week as they failed to acknowledge the claim.

I have just had a phone call from their solicitors saying they never received the claim, and offering me half the money. They said if I don't accept they will apply to the court to have the judgement set aside.

What should I do? Am I now legally entitled to the money, or can they still wriggle out of it?
  • Did you find them very aggressive? I did - have now texted and refused their offer and asked for further offer to be put in writing - I do not want to talk to her again,

  • Hi,

I have sent 2 letters to amex now and had the same one back twice. They state in the letter that the charges are fair and reasonable and signed by me in 1999. Our previous default charges will not be amended. Do I just proceed to the next stage of court action?

    Help would be greatly appreciated.
    Mant thanks

After sending letter 1 off to "A/E" to claim charges back, The statements have come back and include an outside agency fee (debt collectors?) of £700+ that l was not aware of

Now that this account is closed, could l or do l have a chance of getting this money back, if so, how would l go about this? Could l include this charge in letter 2 from this site?

  • I know you can't claim service charges as your paying for a service and isn't a charge which case it isn't an unlawful figure.

reclaiming charges from American Express is it possible

can some one help me with this one
I have a company / corporate American express[ charge card ] not credit card for work use only with my company name and mine on it
I am responsible to pay it off each month,,yer right
but over the last five years things have been very tight and I have use the card for normal every day use like buying food / petrol / and even getting cash out on .
I have all ways been late with paying the amount off each month and some times even missing some months.
as a result I get a late payment fee and a interest fee added on each month normal about £21.95 and 20.95 each month
as I stated this has been going on for some time ,
well last year I really was in a mess with the old council tax and had to pay a whole year tax over two months then their was Christmas to deal with
as a result I missed three months payments.
and had a balance of about £1250 to pay off witch I could not pay
    so
    AMEX canceled the card
as you can guess things hit the fan big time and I came to an arrangement to pay off the card over the next 4 to 5 months which I have dun
    well almost
but each month I get hit for interest and late payment fees of about £40 to £48 pounds

what I would like to know has any one ever clamed back from amex late payment fees or interest on a company corporate card ?

and if I did what position would I be in with my company as their name is on it as well as mine but it is my responsibility to pay it each month

any help with this one would be good
    thank you

Hi, I have issued numberous letters to american express and the pre court letter recently. The have sent me a reply, stating that because the card is (was) a corporate business card it is different from a consumer credit card. I said to them on the phone that the charges were approx £283 per month, which me as a consumer was paying not a company or business. The total claim is for approx £2660. Can i proceed with court or is it correct a corporate account is different. I really dont know what to do now, and worried that if I issue court that they are correct.

    Many thanks

    hi people,
I've just received a letter from American Express giving me a cheque for £77, i asked for £160.At the top of the letter it says WITHOUT PREJUDICE SAVE AS TO COST'S.
    It refers to a previous letter 'the OFT's identified legitimate costs for staffing etc;
Following OFT's recommendations, American Express carried out a review of default charges. the result that from 1st July 2006 the default charges applied to American Express Credit Card is £8.This figure is lower than the threshold set by OFT .
Are American Express trying to bully me as the last paragraph it says that they will go to court to defend themselves and recover its cost.
