    Given that American Express is a credit card like any other I can see no reason not to reclaim in the same manner as you already have with the banks. Amend the templates accordingly with regard to the charge names and good luck :)

    anyone tried to claim back charges from them? any successs? I have sent off my letter yesterday and would like to know what your experiences are...

    New to the forum and hope I've posted in the right place.

    I am in the process of claiming back excessive credit card charges which were levied against my account between July 01 to March 07. The total amount of the charges with interest is £478.42. Since the OFT recommendation, American Express now charges a default charge of £8. Since 2001 I have paid between £15 to £25 in default charges.

    American Express has written back to me saying that they have informed the OFT that their default charges are £8.00 and reflect the costs involved in administering accounts in default and are calculated in accordence with the guidance issued by the OFT.

    American Express have stated that they will NOT refund any previous default charges. I have calculated the difference between the original charges and the current charge of £8.00 to be a total of £229.00 that I have been overcharged in the last six years.

    I would be grateful for any guidance on how to proceed. I am happy to accept the difference (£229), rather than the full amount of £478.42, but do not want to let this go. For Amex to amend their default charge from £25 to £8 is proof of their greed, and I feel that I am entitled to a refund of at least the difference between the original charges and the current charge of £8.

    Has anyone else found themselves in this position ?
  • I think that you should go for the whole amount, unless they can prove it costs them £8... If someone took £500 off you in the street and offered you £250 back would you take it????

    I agree with MadHatter. The OFT stated the £12 as 'reasonable' but the law has not changed. Until the true cost is revealed and a court rules on it you are entitled to claim the full amount. My advise is also not to settle for any less.

    I have just got a letter back from Am Ex stating it was in their t&c's about interest and charges which I signed. Some months i got charged the £283 in charges. Can i still fight this or are the t&c's correct? Same goes for the halifax credit card

    Amex called today following my moneyclaim action. I've claimed £485 + interest + £50 moneyclaim fees.

    They have offered the difference between my late charges and the £10 OFT accepted fees plus the £50 fees. I was trying hard to get to nursery to pickup littlun so said I needed to think about and would they call me back tomorrow at 8am.

    What do you think - should I hold out for the full £485 or do you think I could bargain getting back my card (recently suspended but has a NIL balance). I find the card useful to use when OH and I have to travel for work, and only use it for reclaimble expenses or for guaranteeing things like being able to charge stuff in hotels.

    Any ideas? thanks

    It is entirely up to you but with a little one to feed clothe and spoil i would hold out for the lot :)

    You are entitled to reclaim the full amount and not accept the difference. This is offered in such a way as you think you are getting what you are entitled to, you're not.

    Also do not accept anything over the phone - ever. Always always get it in writing and check the conditions of your settlement. You will probably be asked to say you wont claim again, which you may have to.
