Why on earth would they rip out the kitchen.

Some folks are unbelievable - these lot seem to be greedy, grasping individuals who are obviously miffed that the house has to be sold - maybe the deceased didnt leave them enough cash?
It is such a glorious day today that I went for a thinking walk (ok I walked to Aldi and back:D), it is the first time I have been outdoors this year without a coat too. I had a good nose in people's gardens on my walk and was inspired to buy a bunch of daffs - they were 89p in Aldi and when I got them home realised that where I thought it was one bunch there were actually two in the packet. Got some bits for mum too - some poached egg pockets and a box of cornflour. I got my toilet brush, some mince, sausages, choccie bars (love their Racer bars - like Topic only nuttier and nicer) and some multi-seeded baps. I took time and had a look at the white bathmat as well as the pedal bins (mum is getting me these). I am liking Aldi more and more as they now have baskets so you don't have to struggle finding boxes to lug about whilst you fill them with goodies.
The walk back was lovely and I got some thinking done at the same time. Arrived home to find paperwork from the court which now needs to be completed and sent back (I will hand deliver it), I also had a letter from the waterboard saying they have put me on reduced rate (single person's because I cannot have a water meter) plus an auction catalogue for my goodies that are being sold on 2nd April. They didnt take a picture of the gaming counters but then they are mother of pearl and don't photograph that well, the lightfitting that was given to me by my aunt many moons ago (too big for new house) looks rather fab - so good in fact that I would buy it if I saw it:rotfl:0 -
They would be on a sticky wicket ripping out a fitted kitchen BTW.
If you imagine tipping the house upside down and shaking it - everything that doesn't fall out is "fixtures and fittings" and should go with the house.
If the sales particulars state "kitchen" - then their solicitor should slap their legs for even thinking such a thing. Likewise if sales particulars state carpets tey too should stay (BTW second hand carpets go for pennies so they will be out of pocket by the time they pay for someone to lift and remove them)
Now is the time for Mum to develop a "broken record" and keep doing what she is doing - the offer is the offer and includes what was stated, I am not interested in negotiation.
.................. of course, you could put the fear of God into them an start viewing with the Estate Agent Again (and their main competitors) - the EA won't want to lose a commission.
And - the good old standby when playing "Property Poker" - Gin!!!!! Keep your chin up - all will come good in the end.

Thanks MG for your wise words. Mum is quite sharp and has already arranged a viewing with the selling agent to view another house plus she is looking at other agents too. Mum looks and then tells me if she thinks that I would like the house and then I go and look at it. Mum won't be messed about.
The kitchen is mentioned on the particulars, however, the carpets are not (I have just checked) but the agents told both me and my parents (different employees doing the viewings although one that I saw was the same as one that mum saw plus mum saw a chap) that the carpets were included.
I am just sitting tight - I know that it will come good in the end and if not then it wasnt meant and the vendors will end up looking stupid. That house was on the market for quite a while before we viewed it and in the month or so when we were looking at it, the house had no other viewings.0 -
Date of seller purchasing the house is usually evidenced in the Office Copy entries, your solicitor will advise.
The date of the original purchase from the Council will be evidenced also in the title, there will be reference to this in the title, again your solicitors will advise. Dependant on when teh property was purchased the price paid will be on the office copies, if not the price paid when purchased from the council will be set out on that transfer.
In the case of an executor sale it is usual to have limiited information about when any works were carried out - if you are having an official search the result will indicate any works which require compliance certificates, chances are from what you have said the works will have been done prior to the compliance certificates being required.
If the boiler is two years old it should show on the search.
Sounds like games being played re the kitchen - never heard of anyone ripping one out in 17 years!0 -
Mum's solicitor is on the case.
Mum has decided to view two houses for sale with the same agent - these houses are in roads close by and are slightly bigger - both of them have garages in their back gardens. One house overlooking a green has an electric hob (I hate cooking with electricity) yet has gas central heating and the other has a gas hob and gas central heating. No harm in looking. Unfortunately these houses are outside of the budget that mum has and I cannot afford to put anything towards them:( (both are over £100K - one being £114,950 and the other being £115,950).
I think the problem lies with the brother of the deceased and his wife, the other executor is fine being both friendly and informative. Mum's solicitor has asked for various documents to be supplied and is conducting a search. I cannot understand the game playing myself - why do it when they have a cash buyer?
In other news - I have more papers for the court to complete as his nibs has now signed them (can't remember if I mentioned this earlier). Brain is sleepy - fell asleep on the sofa after lunch again..sigh.0 -
Makes you wonder if something underhand isn't going on with the executors. Ie trying to buy the house at a discount, because they already have another buyer. Sounds hinky anyway.....

Chev - nobody other than my parents and me have viewed the house. I think it is just the SIL being grasping and greedy.
Mum has a good solicitor and in his searches, he has found that there is a tithe attached to the house in respect of the local church. Mum can remember the church being built in the 1940's. This tithe means that any time the church want to undertake repairs then they can get the householders to pay for it. He advised mum that it would cost £138 to insure against tithe payments and this will provide cover for 25 years and has suggested that this be paid by the vendor.0 -
Sounds like he has done a Chancel Search - unlikley Vendor will pay. however insurance can be got for £15.00 nowadays as it is such a low risk.
Keep on in there - you will get it in the end!0
