PARKING EYE are lying to me! How to prove it?

    This is an information page for the thousands of people who receive "tickets" from private companies in the UK ever day at supermarkets, retail parks, and in any other privately-owned carpark.

    We are NOT encouraging anybody to openly flout parking restrictions on private land, or to refuse to pay reasonable charges for parking. Landowners have a right to make reasonable charges for the use of their land.

    1. What you should know about these companies

    It is important to remember that private parking companies (or PPCs as they are often called) have NO OFFICIAL POWERS - that's right, none at all! They give out their "tickets" on the basis that you have seen the signs in their car park and that you have therefore agreed to a contract obliging you to pay a certain sum of money.


    2. What happens to people who don't pay?

    In 99.9% of cases, absolutely NOTHING! The company pays the DVLA £2.50 to get your address, and then sends lots of threatening letters. In the main, these letters can be safely IGNORED. The only way the company can actually force you to pay is by taking you to the small claims court, which costs them even more money. And they are by no means guaranteed to win! And they practically never do.

    The two main reasons for this (among others) are the following:

    - Only the person DRIVING the car could ever have agreed to any such parking contract. The company can only get the Registered Keeper's address from the DVLA: you don't have to tell them who was driving.

    -Many of these charges are so extortionately high that they constitute a penalty, which is unenforceable in a consumer contract.


    3. Can they affect my credit rating?

    NO! The only way your credit rating could be affected by ignoring private parking companies is if you were taken to court, lost, and then still refused to pay. But they will not take you to court.


    IN SHORT

    The vast majority of the time, you can safely IGNORE tickets from private parking companies, they are not official fines.

    The vast majority of the time, you can safely IGNORE the threatening letters, including those from debt collection agencies.

    You DO NOT have to pay a penny of your hard-earned money to these companies. Remember that the chances of being taken to court are very slim indeed.

    DO NOT IGNORE COURT PAPERS!
    If you receive real court papers from a private parking company (very rare) then you should go to http://forums.pepipoo.com or http://www.consumeractiongroup.co.uk/forum/parking-traffic-offences for help defending the claim. Do not be afraid to sign up and ask questions regarding any paperwork you are not sure about.

    I'm thinking some of you are taking the mick now... This is all a big learning curve for me as I've never got a parking invoice in this way before.
    There's no way P.Eye would dare take me to court as they don't have a valid case on many grounds (obviously)!!
    But there's no harm in writing to Aldi, it's no skin off my nose. If I get a negative reply which I probably will I'll fight fire with fire.

    I head any letters WITHOUT PREJUDICE.

    No where have I agreed with or accepted what Parking Eye have said; the invoice was paid for under duress stating if I find they have breached any terms of contract this payment would not have been sent. They have, with the DVLA, and the fact remains I've still paid it, but at least I'm now not sitting on my laurels.
    ...(Actually I am ..a little, now that I know I can rest easy, lol).

    My daughter got a car parking fine for a ticket that turned over in the car (no sticky bit provided) We have kept the original ticket
    We have read all the threads on here and are ignoring all letters as advised by the forum.
    Just wondering how long the letters keep arriving before they stop as it has now been passed on to a debt recovery service and they keep threatening and I tried ringing them to say there is nothing to support them in a court of UK law to make us pay a fine for parking on private land especially when she has the ticket. I said we won't be paying it. Do they just give up after a while?

    Any comments form others in this situation/

    Ignore then, you've got a ticket saying you've paid the landowner for use of his/her land, so the damages will be zero.

    Parking Spy rarely do court so you don't have to worry

    I stuck to my guns with Aldi and pursued for all damages incurred.

    They eventually agreed to cancel the invoice (which I reminded them was null and void anyhow as Parking Eye have been unable to substantiate their claim with appropriate citations of case and statute law blah de blah )... and they instructed Parking Spy to send me a full refund, which they did.

    Aldi did not reply to my last letter which told them that PPC's like Parking Eye have been on Watchdog and have they considered a fairer system.

    I used to be regular shopper at Aldi but have not shopped at Aldi since.

    Word is also getting round that you can park at Aldi for your shopping for as long as you like as their system is unenforceable and unfair to even the genuine people who shop in their store.
