The instructor does not have a speedo in front of them though. This is the responsibility of the driver to keep checking on during the lesson.

I was shocked when I googled it.

Doesn't seem right somehow, afterall when learning to drive there are so many different things to remember.

If they struggle to keep an eye on their speed, maybe they shouldn't be on the road in the first place?

I was going to say that, should learners not be on the road until they have competent with all aspects of driving.

Afterall, if a learner cannot yet control their speed then how on earth are they going control the car if they need to break fast etc.

Nice to see another thread where a somebody is trying to look for a way to blame somebody else.

Who is to say the learner wasn't told several times to slow down but ignored the instructor.

I never got caught speeding when learning to drive.

Instead of trying to blame somebody else how about taking some reponsibility and going to.court to explain the mitigation, that the driver was under instruction an momentarily strayed above the posted limit due to lack of experience.

Though perhaps a little overconfidence was also to blame.

The NIP would almost certainly have gone to the driving instructor who would have informed the camera partnership who was driving and they have now sent the NIP to the learner driver so I thonk.it is obvious who they think.is liable.

While the instructor has to be much more aware than your average driver, it only takes a second or 2 to go from 30-36mph and the learner needs to be able to demonstrate they can control their speed without the instructor intervening all the time with the dual controls. For all we know the instructor may have warned them about their speed already.

Don't try and pass the buck to someone who needs their licence for their job.Imagine if they had 4 such pupils, they would be out of work.

I don't see why it raining should make the learner go faster? It should be the opposite.

I think post#2 is highly relevant

What I think vax was getting at is that the driving instructor must have nominated the learner as the driver, but has he got the correct learner. I know he will have records but I would want to see a photo too, rather than go by his word.:A

Other than that 36 in a learner car in the rain????? Learners fault legally , but also for chosing a careless instructor
I like the thanks button, but ,please, an I agree button.

Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

Always expect the unexpected:eek:and then you won't be dissapointed

Not just other students, the instructor needs to get to you and onto the next client. Past the same camera?
