Speeding ticket

My daughter was on a driving lesson and has received a speeding ticket. 36 in a 30. She has only had 10 lessons and it was the first time in the rain.

I know she should be responsible for the speed but surely the instructor should have warned her of checking her speed especially near the camera.

Is there any way that the instructor is liable or should pay the fine?

    LOL are you being serious?

    Who was driving at the time? Your daughter or the driving instructor? Why would the instructor pay or be liable when he wasn't driving?

    Your daughter should be paying attention to her speed, just like everyone else who drives.
    What is pi? Where did it come from?
  • Yes, but learners are learning and will make mistakes. How about if she went through a red light or overshot a junction? The car is dual control so what is the point of that then?

    Then I'm sure the instructor would have used them if s/he needed to. However, s/he can't keep an eye on your daughters speed all the time, thats down to your daughter and no one else.

    Its not the end of the world at the end of the day...take it on the chin and learn from it.

For speeding offences the points will be endorsed on the learners licence and they will have to pay the fine.

    The OP's daughter is not 'just like everyone else who drives' though, is she. Far from it - she has not yet demonstrated her competence to drive. That's why she has to have someone with her at all times. The principle that a driving instructor (or anyone else who sits in with a provisional licence holder) can share the liability for offences is well established. I'm not sure whether there's much you can do for a simple speed camera offence though.

    When my daughter had driving lessons, I always assumed that the instructor would monitor her driving thoroughly. That would include making sure she kept within the speed limits.

    I would certainly ask the instructor why he allowed this to happen and whether he accepted any responsibility.

    The fact that she was doing 36 in a 30 mile limit area after only 10 lessons would suggest to me that he was not doing his job properly.

    May be difficult if he's a one-man-band, but I would certainly make an official complaint if he's working for BSM or the likes.
