    If you are referring to Section 172 then driving instructors, like companies for example, are expected to take steps to know who is using the car. However in the event that, lets say, during a 1 hour lesson both the instructor and pupil have used the car then it may not be possible to identify who the driver was. Despite reasonable diligence, in such circumstances it can be that neither party is liable for a penalty - however I believe there have been certain instances when a court has given both a fixed penalty and points.

    What are the odds of that oher than on the first lesson? Vey slim and any how the instructor has already nominated the pupil so I guess he knows who was driving.

    Look, my point is, if the accused driver does not believe they were the one driving and the camera footage is not revealing - then they should not admit to the offence; even if the driving instructor claims they were the driver. It may be very easy to make the driving instructor unreliable in court.

    My daughter was on a driving lesson and has received a speeding ticket. 36 in a 30. She has only had 10 lessons and it was the first time in the rain.

    I know she should be responsible for the speed but surely the instructor should have warned her of checking her speed especially near the camera.

    Is there any way that the instructor is liable or should pay the fine?

    Same really, I compare it against those mobile speed camera things they move around lamposts that show you exactly how fast you are going.They have all(except one that was obviously faulty) tallied exactly with my readings in various vehicles.
    I think the 10% thing is something people read on a forum, take it as gospel for all cars and then perpetuate the urban myth by reposting it on further forums.

    I've got a 67 beetle.
    The speedo on that connects to the hub with a cable, as the hub spins the cable spins a magnet in the back of the speedo, that drags the magnet on the little pointer against a spring. I can belive that's not as acurate as my Zafira.
    On that the ecu counts the number of turns the reluctor on the abs makes, works out the speed based on the size of the wheels and tyres that it was built with, and sets the stepper motor in the speedo to the correct position for the speed it has calculated.

    The beetle doesn't usually agree with the sat nav, but if other modern cars are so bad, it makes you worry about the rest of the engine management system and build quality though.

    But for ffffsake he needs to prove this by requesting photographic pics, it's quite simple if you take the time to think for a minute,

    Who needs to prove what?

    The instructor has nominated the pupil, has the OP stated anywhere that there is a doubt as to who was driving?

    I've got a 1952 knob, that's getting pretty unreliable too nowadays, :o:o:o, ;)

    Nowhere has the pupil/pupils mum accepted that he or she was driving, and we have only summised the instructutoe has nominated the pupil in question.
    Check back. Proof is needed fella, as this is a little unclear.

    Nowhere has the pupil/pupils mum accepted that he or she was driving, check back. Prove is needed fella as this is a little unclear.

    Why should she be responsible if she was sat in the passenger seat?

    Where did you find this bit of useless information? where does it say that an instructor MUST buy a second speedometer before a car can be used for delivering lessons? Road Traffic Act ? Construction and Use Act, !!!!!!!! down the Pub Act ? ahh I think I know :T
