    The police officer did not give you a FPN? Did he give you anything at all???!!!

    You don't just get a summons through the post, you must be given something to inform you of what you have done wrong and what will occurr.

    Are you sure in the heat of the moment you heard correctly? Are you sure you haven't just been given a warning not to do it in future and that is the end of the matter?

    He told me as the conversation finished to await a summons. He gave a producer and a yellow ticket to have stamped at a MOT station for a defective back ligh.

  • If he didn't give you an FPN at the roadside it sounds like a process book as he did give you a producer/HORT1. He would however have completed some of it at the roadside as there are bits you should sign, in this case a summons will arrive by post. Process books are usually for more than one offence as a FPN can only be issued for one offence. This may explain the lack of paperwork/what happens next type info at the scene.

    The broken light thing was a Vehicle Defect Rectification Scheme (VDRS). Really can't beleive he filled one of those out!!

    This has got loads of people at work interested.

    PS If you say your never going to pass info to the police again how am i ever going to get all the bargins on this site!!!!! he he;)

    Let's see what the summons says, but it all sounds very petty.

    I remember hearing about this before a few years ago, when a woman was fined for drinking from a bottle of water when she was stopped at a red light in a queue of traffic, and had her handbrake on.

    Absolute madness. :eek:

    While we're (kinda) on the subject of traffic law, can any policemen/women out there settle an argument for me once and for all? You know the circular sign that is white with a black diagonal line on it - what does it mean? The highway code says it means 'national speed limit'. I take this to mean that, for example, if it was displayed on a dual carriageway then the limit would be 70mph and if it was on a single then it would be 60mph. I have many friends who argue that it always means 60mph, no matter what kind of road it is. Surely this can't be right? If so, why even have this sign and not just use a 60 sign?

    Having read the thread so far, it makes quite interesting reading by the way....I'd be surprised if a summons arrives in the post, if, and I don't think it will, I'd love to see a scan of it on the forum...don't suppose you've contacted the local station to try and find out more about it....did the officer add his number or name to the rectification notice....if you want to go down the route of challenging this "offence" by complaining about police conduct etc....it may be better to strike first rather than wait for the "summons" to arrive then react, pro active is the best way to go about it....still, I believe it sounds like an idle threat from the policeman....after all....he had to scour your vehicle to get something on you.....dont forget , theres three sides to every story.....your side, their side and the right side.....

    good luck....take the fight to them....what have you got to lose?

    Guys, just so you have a clear picture in your minds eyes, here is a count by count of the incident.:mad:

    As I got to the bottom of my street (T-junction) I noticed a cop car parked up on the other side on the junction a little further down the road. For some strange reason we all made eye contact as i approched the junction.

    I turned left for about 100 yards to another Junction (main road) I turned right and carried on for about 200 yards. I pulled into a lay-by outside the newsagents. (the lay-by was Empty but room for 5 cars) I got out of my car and walked 30 yards to the shop,to buy a bottle of milk.

    I returned to the car (still no other cars parked in the lay-by. I got back in the car, turned the ignition on, open the bottle of milk, took two mouthfuls, put the lid back on, put my left arm across to put my seat belt on. Tap, tap on the window. :eek: They have crept up on me while I’m drinking the milk and I haven’t noticed them. :mad: I opened the door as he has stepped back. I got out the car and without saying anything he pointed to the bottle of milk lying on the passenger seat. “What’s the problem officer” looking at him somewhat confused. “Did you know what you have just done is as dangerous as using a mobile behind the wheel”? “Officer, I wasn’t driving, I am parked up, and you can see that” :confused:

    He then pointed towards the keys in the ignition. “You are in control of a vehicle. Then I noticed the other cop get out of his car. He had obviously been running a check on my car. He started to check my tyres, tax disk, and looking around inside through the side rear window.

    Anyway this cop questioning me asked if I had any doc’s on me. All I ever carry is my driver’s licence, more for ID than anything else, so I gave him that.

    He said he was going to issue me with a fixed penalty for drinking milk. I said “you got to be joking me right” He then reached into his case to get the paperwork.
    Feeling wounded, hard-done-to, my exact words were “mate, you can stuff your fixed penalty, I’m a law abiding citizen of this country who pays his taxes and has a clean record. I’ll go to court and explain my side of things” He said “that’s ok, there is two of us and only one of you, who are the courts going to believe? And it will cost you more than thirty quid” with a slight pleasurable expression on his face.

    He then said he was going to give me a producer and continued to write it out. Suddenly the other cop that’s checking my car shouts over to his mate “we got a defective light here.. Look, here look” the cop standing with me continued to finish writing the HORT1 (as we now know it) :D
    He asked me to sign it, to be a smart mouth and to have my two penneth, I asked him if he could give me a reference in law that indicated I have to sign the HORT1?
    He said “you don’t have to sign it if you do not wish too” SHOCKED.. So I declined.

    By-now they were both oozing bad vibes. There mannerisms changed
    I felt that the situation could easily deteriorate so decided not to give them the pleasure. I only answered there question in a polite manner thereafter.

    My parting words with them were “You both have a nice Christmas. Bye”

    There was no mention that he was going to report me, or for what.
    There was no caution.

    Just the producer and defect ticket.
