There are loads of examples of Police issuing fines for this type of thing, but to be honest it's petty.0 -
Jesus guys.. what the hell have i got to gain by Lying?
Like I said in my last post, I told him to stuff the ticket when he said he was going to give me one. . Is exact words were “that’s ok, there’s two of us and only one of you, who are they going to believe? Its going to cost you more than £30 going to court” and then gave me a producer, tax insurance, licence, mot and some other yellow ticket to have a bulb fixed on one of my tail light. Had it signed by a MOT station and returned it within the 14 days.
I will post the summons as soon as i recieve it.Your tax bill is the penalty you pay for not helping the right candidates get into office.:D0 -

Im not sure I understand this either, we often pull into a layby when we are out working, and eat our entire lunch.!! Drink, food and even the odd 3 or 4 doughnuts. If its cold out we leave the engine running for the heater. Most people who are on the road have their lunches in their cars or lorries, and if you pop into a newsagents to get a paper and a snack you would perhaps it it whilst your sitting there.! Surely if the car isnt moving and its in a layby or even at the side of the road this ticket would not be possible.?

My hubby got a ticket, when he stopped outside the cash machine.
The cops in the court opposite came running out and stuck one on.
But when he got caught doing 96mph down the m4 they let him of with a warning as they were busy waiting for someone.
You can't tell, perhaps they were bored and had nothing better to do.

OK so we've all assumed this is real, and it's an interesting debate even if not.
On what grounds can this possibly be legal? The crime, as far as I can see is "not being in proper control of a vehicle". Since, I assume, the handbrake was on and the vehicle was in neutral then how can you possibly not be in control of the vehicle?
Take it to court, although I very much doubt it will even get that far. If it did then a judge would throw it out quicker than you could say "police harrassment".Says James, in my opinion, there's nothing in this world

I asked a friend of mine (who works in the control room and monitors the city center police cameras) if he knew what the likely charge would be. He seems to think that driving without due care and attention is the most likely charge.
That’s leads onto: I wasn’t driving, I was parked up. Having my keys in the ignition (as the cop pointed out) as being defined as ‘in control of a vehicle ’ is my downfall. Had they been on the passenger seat, seems there would be no offence.
That’s how I understand it.
Maybe the cops on here can advise.. or maybe not . :A
I could understand all this sh*t if I were a boy racer, or some hoody or the owner of a couple of ASBO orders.
I’m a 51 year old self employed decorator. I pay my taxes on-time, I have insurance, taxed and MOT.
I do regular international charity work. I go about my bussiness with a high sense of morality and expect thje same in return. I don’t give the Police or anyone else problems. Why do they want to give me problems?
I was chatting to my two boys at work today, on how I should handle this. One said I should just plead guilt and get it out the way. the other says that I should fight it all the way. I tend to agree with the latter.
I have no experience with courts or cross examining anyone never mind two coppers.
I’ll wait for the summons to arrive and post as promised.

If the offence is driving without due care and attention, then they wouldn't have a hope. DwDCaA is a "careless driving" offence which is committed "when the accused's driving falls below the standard expected of a reasonable, prudent and competent driver in all the circumstances of the case."
From the CPS web site:
The following are examples of driving which may amount to driving without due care and attention:
overtaking on the inside;
driving inappropriately close to another vehicle;
driving through a red light;
emerging from a side road into the path of another vehicle;
Conduct whilst driving, such as:
using a hand held mobile telephone while the vehicle is moving;
tuning a car radio;
reading a newspaper/map;
selecting and lighting a cigarette/cigar/pipe;
talking to and looking at a passenger;
