    So you've had a refund but refuse to return the item? You simply can't keep it if you complained about it and have been refunded on it. That isn't how things work. Just because you were refunded by both instantly doesn't mean that either are admitting guilt or liability. Maybe they were trying to save their feedback rating. I've had things I wasn't happy with in the past and been refunded, but at NO POINT did I think I could keep the goods too.

  • If the goods are fake they should be taken to Trading Standards for inspection, they should not be returned to the seller.

    People who sell fakes goods know it's easier to refund to try and preserve their feedback (not just on Play) and to help prevent people complaining or opening disputes, also not asking for a return means you don't know the seller's address to report them to TS or the rights owner. If someone accused me of selling fake DVDs I certainly wouldn't be refunding as I know the goods I sell are 100% genuine.

    Yes, I've had a refund and refuse to send the goods back. They chose to sell me fake goods, I chose to demand a refund and not report them to Trading Standards & Play for selling counterfeit goods. That is exactly how it works.

    I'm sure they did refund to protect their feedback. I wouldn't like 'fake goods' mentioned in any feedback I may have. If I was accused of selling fake goods, when I new without a doubt that this was untrue, I would fight my corner. Feedback or no feedback. They were guilty and they new it.

    If you choose to believe that I'm in the wrong by not returning goods that were sold to me as genuine and were not, fair enough.

    I paid £28.00 for a fake DVD and £19.00 for a fake game...and they weren't even decent fakes! I believe that if you were in my position, you would do exactly the same, as would the majority of people.

    No, I for one definitely wouldn't.

    Although you may believe that he's just going to sell them on to someone else that may not be the case. That way he can't sell them on and you don't look like a low life scammer.

    If the person selling the items was not aware that they were fakes - for example he got them from a job lot and didn't examine them carefully, he'll just assume that you are a thief.

    If you believe they are fake you should send them to your local trading standards and tell the seller that he can pick them up from there.

    Fair enough, but the first 'fake' feedback dates back to October last year, so I think if he was concerned, he would have switched suppliers by now.

  • OP you say you choose not to report them? You should have left negative feedback stating the Disney DVD was counterfeit and you should have reported the seller to Play and Trading Standards. This will save others suffering as you have. The same goes for the game if you are sure it's counterfeit.

    Some years ago I bought some software on ebay that turned out to be fake.
    The seller refunded, so I didn't lose out.
    But I tried to take it up with both ebay and the software manufacturer (Symantec), and neither were in the slightest bit interested.

    Ebay are completely hopeless. If anyone tries to sell something from a manufacturer on their VERO list, it will get pulled even if they are perfectly entitled to sell it.

    If it's not on the VERO list people can sell whatever counterfeit stuff they want and fleabay will do nothing.

  • eBay are hopeless but Paypal aren't, if you report to their AUP dept via email they will ask the seller for invoices and suspend the Paypal account if they come to the conclusion the goods are counterfeit.
