Fake goods on play.com

Hi there,

Last week I purchased 10 different items (games & DVDs) from play.com all from different sellers. I have received all of the items and out of the 10, two have been fake/counterfeit.

Firstly a sealed Disney DVD. The cover was littered with spelling mistakes including carpet spelt 'carpel' and Aladdin spelt 'Aladon'!!! Secondly a gameboy advance game that didn't have the nintendo seal or the code at the bottom right.

I emailed both sellers, the DVD seller just refunded and said sorry you weren't happy, the second refunded and gave all sorts of excuses, they are imports, didn't know etc. The second seller asked me to return the game for him to investigate. I refused as I believe it is against the law to send counterfeit goods through the post...is this correct?

So, 20% of the goods I purchased from play are fake. I'm not sure what to do. I have been refunded without question and I know that I can leave feedback etc, but should I report the sellers to play? or is it pointless as they probably won't do anything anyway.

I just find it infuriating that a reputable company like play allow this to go on. Are they breaking the law by allowing the sale of these goods on their website?

    If he's given you your money back and keep his item then your nicking it really.At least give him the benefit of the doubt an let him investigate it.Returned at his expense ofc.

    Just a minor point, you didn't buy either of the fake ones from Play, you bought from Play Marketplace. Play will be quite cross and justifiably so if you accuse them of selling fakes.

    If you're not going to return the fake, the least you can do is get genuine proof that it's fake, and send them that!
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    If the good are fake I think you should inform Play - might not do any good , but you never know, perhaps Play will do something? May eventually save someone else the hassle of receiving fake goods. I think Amazon and Ebay take a dim view of fake goods being sold on their sites (not to say it doesn't happen of course) and take action.

    Shouldn't you hand the goods over to Trading Standards, and inform Play and the sellers you have done so?

    Of course, I understand that the items were purchased from playtrade and not play directly however, play are allowing it to happen, although I appreciate they probably don't know.

    As for sending proof that its fake, to be honest, my 8 year old new straight away that it wasn't right. I think a seller with over 900 feedback should know. He made all sorts of excuses, didn't know, it was an import etc, all nonsense. Any seller worth their salt would know straight away that it wasn't right.

    I have also absolutely no intentions of going to the bother or expense of returning the goods. They know that they are fake. They refunded me immediately. If I was accused of selling something that wasn't genuine, when I believed that it was, I would certainly put up some kind of fight.

    Anyway, thank you all for your input. I just want to warn people to be alert when buying from playtrade, you may not be buying what you think you are.

    She bought the good from the Play site - i.e. Play.com.

    Which is exactly what she said.

    I assume you will be destroying the item and certainly not using it after you've received a refund and refused to send it back for the seller to investigate.

    If you are however going to keep the item and play the game then in my book you're worse than they are.

    I feel quite uncomfortable about this. If I was selling something and the purchaser said "its fake but I'm not going to return it so you can investigate" I would feel I was being done over.

    Well the moral of that is make sure you don't try to rip people off by selling (bad) fakes. I fail to see why you are uncomfortable? Not one of the sellers put up a fight. I was refunded immediately without question by both, which in my eyes means they new exactly what they were selling.

    If a seller of games and DVDs can't spot a fake, they really shouldn't be trading in the first place.
