5. The Order requires that prices must be "unambiguous, easily identifiable and clearly legible" but it is not prescriptive about the way in which those requirements are met. It does, however, require that consumers should not have to ask for assistance in order to be able to see a price. Legibility of price indications in this context means legible to a consumer with normal sight. Traders are, however, reminded of their obligations under the Disability Discrimination Act 1995 and to take account of the special needs of the elderly and disabled groups. When considering the needs of those with less than perfect eyesight, traders are encouraged to take account of the Royal National Institute for the Blind’s Clear Print Guidelines.

It does but it does not say they should give you DTD, DTD is a Tesco policy. You could report them for a breach of above but Trading standards cannot make them give you DTD. Tesco have a track record of trying to wriggle out of their own policies! If they can't keep to their own advertised policy of DTD when they a make a corker of a mistake then they shouldn't have the policy. When I refused an R&R on a phone I threatened them with the ASA because they advertised this policy, I filled out an online complaint form and sent a copy as an attached document to Tesco HO (Terry Leahy) I got my R&R from the store but the ASA did eventually tell me that they would not have taken action because the policy was only advertised within the store.
So I would say kick up as much fuss as you can and you will probably get your DTD but don't count on trading standards to make them give you DTD that decision is made by Tesco only.0 -
Got a nice DTD today.
My son asked for the Primeval series 1 and 2 dvd boxset and the SEL said £17.97 which is a fantastic price anyway so I agreed.
It went through the till at 22.97 and the lovely lady at CS gave us a tenner back and then explained that there policy was DTD which was why we had been refunded more than a fiver. Very refreshing to have such an honest and pleasant person at the CS desk.
Price paid therefore: £12.97!0 -

Just a couple of nuggets to add to that:
For a high value DTD refusal I'd consider a claim in the county court for breach of contract. The sign on the wall forms part of the contract you choose to enter into when giving Tesco your business. I'd dearly love to see Tesco put their "out of date SEL" argument in front of a judge (they won't, though - they'll just pay up after you issue the claim).
Also, if they're not honouring DTD, the policy is a breach of Section 14 of the Trade Descriptions Act. Trading Standards can prosecute them under this act for displaying a policy which is "false" on account of the fact that they won't honour it.
However, persuading Trading Standards to actually do this will be a whole challenge in itself.0 -
£1 off shelf price label on jar of 200g Kenco coffee. Shelf price £3.64 - charge £2.75 (£1 0ff).
It took 20 minutes or the CS to say I was looking at the wrong price then saying 'Oh Ill give you 11p' after I took her to the shelf but she was adament I was only getting the 11p.
Also refused to give me 100 points for a mother & baby coupon as she said baby powder didnt qualify as a mother & baby item?

I could shake myself I gave up on a n OOD xbox SEL argument, day after I took it back for a refund HO phoned me and from what I could gather were about to give me my R&R but didn't want to know once I mentioned I had returned it - what a fool I was, I just assumed take it back go for easier R&R and then it finished. Still I must have got a fair fair amount while it was going. I'm not keen on DTD.0 -

Perhaps not the best way for a new forum member to curry favour amongst fellow MSE's - I know it's an open forum, but I think this thread is at risk of going seriously off-topic if people start retaliating to "Th3 Ripper"s comment. Perhaps it would be best if a BG deleted the post? :think:

You are not forced to view this postings and critisise peoples' postings.
I don't see you complaining about Tesco's policy to overcharge people all the time. If 100 people buy (for example) a jar of coffee advertised as £3.00 and they actually get charged £4.00 for it, only 5-10 of them will actually realise the overcharge and ask for the money back. In another words Tesco will make £90 profit out of nothing. And guess what... it's not only coffee jars' prices they get wrong... Does that bother you one bit???
If Tesco make a price promise, all we expect from them is to keep it. And that also seems a bit hard for them to stick to.Going to war over religion is basically killing one another to see who's got the better imaginary friend...:rolleyes:

I agree that when a mistake is made, it should be corrected within a reasonable timeframe. What I don't understand is why people go out of there way to find mispriced products so they can "get one over" a business, Tesco or otherwise.
You are perfectly right that when a product is mispriced the mistake should be corrected. But I don't agree with blatent exploitation of refund policies.
This isn't intended to offend anyone, its simply an observation.0
