Nightmare Help Needed

Hi,

Writing this on a 3g modem in a hotel because of a moving disaster!

We completed yesterday. Solicitor called us at mid day to tell us to get out of our house because the sale money was received.

But the people we are buying from have not received our money so we have not been allowed to move in.

Our solicitors have told us the money has gone but the sellers solicitors say its not arrived!

Then from about 3PM our solicitors have not been contactable! Its now the weekend and no one is available. The estate agents don't want to know and the moving company have put all our furniture in storage and say they will want another £1k to deliver it on another day.

This is crazy! I am sick with worry about where all our money has gone.

Who do I need to talk to, to resolve this!

    So what's happened to your vendors?

    When you say your solicitors were uncontactable, in what way?

    There's nothing the EA can do.

    As far as the removal company is concerned. They'll lose a days work if they don't charge. The issue isn't their concern.

    Hopefully everything will be resolved Monday morning.

    I'm afraid there is probobly nothing you can do till Monday. (unless your solicitors work Saturdays.......?)

    Keep all reciepts in case you have a case against the bank, for losing your money, or the solicitors, for sending it to the wrong place etc.

    But keep your costs to the minimum because your seller may claim you failed to Complete. I assume there is no doubt that your solicitors had the full amount (whether from you and/or mortgage lender)? And they catagorically said they'd sent it? What time was it sent? CHAPS transfers can take up to 2 hours so if it was after 3.00 .......?

    Cut-off used to 1pm for same day.

    I've waited until 4.30pm to receive confirmation that funds have arrived and therefore can collect keys. So can be very late in the day.

    This happens sometimes.

    So, on the plus side: you've got a roof over your head and your stuff's in storage. Re £1000, you can check with them if they do what they call "a part load", which means they'll bring it to you on a date THEY decide, rather than you choosing - it can be half price.

    I'm sure it'll all just magically happen on Monday as the money plops into the bank account.

    Not much I can say really except: It's a !!!!!!!' pain in the butt for you right now, but it'll at least all come good in the end.

    Solicitors stopped answering the phones at 3pm.

    I hope the solicitors got all of the money from our buyers, we were trading down and did not need a mortgage so our solicitors had £250k cash. We even deposited a further £20k with them a couple of weeks ago to cover any disbursements and unforeseen fees.

    I have been trying to contact our solicitors today but the office is closed. I have even driven to the office to see if there is a duty solicitor.

    The vendors solicitors were certain that the money had not arrived.

    There is an event on in our town and the only hotels we could get are £150 per night. All the family are not even in the same hotel as only one room was spare in each!

    This sounds unfortunate. Is this why people are discouraged from completing on a Friday?

    Completion normally takes place on Friday. So that the weekend is available to get settled.

    There is an event on in our town and the only hotels we could get are £150 per night. All the family are not even in the same hotel as only one room was spare in each!
    I'd have gone 20 miles away to avoid paying that.

    Well, on public transport with 3 kids, in the pouring rain with little notice and no way to really shop around as only a mobile phone on Friday, I didn't have much choice.

    As it is I have managed to find a cheaper hotel for tonight.

    I am worried that the solicitor has paid the money to the wrong people. Will they be able to get it back if they have?

    Yes. But if that is what happened you'll have a good case against them. And they'll have solicitor's indemnity insurance.

    When you speak to them, get a clear explanation. Even once it's all sorted, remember your solicitors will be reluctant to admit they sent it too late or to the wrong place etc ie admit responsibility, baut as there are costs involved (yours AND the other side), get them to be very clear. And try to get answers elsewhere too (the vendors/their solicitors/the EA) so you can cross-check the story. I doubt they'll lie, but fudge......
