It is like ours with FIrstplus. We were told that Freedom Finance/Bespoke Finance sold it but we have no recollection of this but then went to pursue them because it was what we were told.
I remember when we received the agreement that PPI was typed in and it was FIrstplus that we then spoke to about it before signing and sending back the agreement. It was then that this was sold to us conditional to the loan as they said we had to have it and it was a savings scheme. We apparently applied for the loan via a teletext add they said, (yeah right) and we applied without PPI (which the application says) but it was added after applying BY FIRSTPLUS. In fact the broker only received commission on the actual LOAN and nothing on the PPI side of it so it seems as the transcripts they sent to me said a commission payment which was 5% of only the loan. I KNOW that no broker was involved in our sale (although the unregulated and untouchable broker will always admit to it!! HA HA) just because they know you cannot get it through to FOS.
Its the same as yours, you know who actually made the sale of it now (you only listened to what you were told and first pursued Click) only because of the paperwork and the recollection of the phone call but one of them did and you only went on what you were told. They are just trying to wriggle out of it and pass the buck over.
They should not make it so difficult for consumers to know who sold what. In fact any adjudicator would be able to get hold of information that you could not so again, there is something going on.

Your right there, he is definately mincing his words, trying to catch me out I think, but the point is the underwriter.
Even so, he was going to come back anyway if you remember with a letter with his decision he made on HFC to say he agreed with them anyway and they would not have been regulated at the time I taken out the loan with them.
So it was back to the underwriter anyway, and if anything, even though the insurance was taken out with Hamilton, we certainly had no contact directly with them during the sale.

The FSCS are trying to target insurers (because they will lose money otherwise) so it would only be fair that the consumer do the same.

I emailed the Adjudicator today just to ask and make sure on what happens now, as I assumed now this would be passed on to the Ombudsman with all the info we passed on, considering he did confirm on his letter we received in early June 2011 that he could not conclude so we would get the opportunity to move this on to the Ombudsman, but it seems he still has a say in it and will be sending a decision/opinion on Thursday this week (I have asked if he would be kind enough to email it though, as hardcopy post can take a while to get to where I live).

I will be conducting a review of the documents you have sent to me and the information provided to me by HFC. I aim to send an opinion out to you on Thursday afternoon. If you agree with my view then the case will close. However if you disagree you case will be referred to an ombudsman for a final decision to be issued.

I have a gut feeling here though and will be way surprised if he decided to agree with us, judging by our experience with this adjudicator over the last few months, but still there's always the ombudsman........:D, more waiting but I've waited this long, so no harm done hey? lol.:D;) xxxThe one and only "Dizzy Di"0 -
As thought, its off to the ombudsman now, the Adjudicator doesn't seem to understand this case - incompetent in this case I believe, so why on earth suggest the underwriter avenue in the first place and waste a few years on this??
