    Since my email above, I have emailed back and said we will go for the extra time, so we have until the 19th July to send in everything and he did get back with an email to confirm we now have until that date, but he will not be looking into the merits of the case, but check if Click sold the loan.:eek:
    And I take it then it will be reviewed in due course by the ombudsman.

    The annoying thing is here, even though I am to send all the info, which we need to in this case, the way he said "check to see if Click sold the loan" well he has a copy of the flipping application form and its also been confirmed by Endeavour to him.

    No offence but we think our adjudicator is a young whipper snapper and with not much experience.

    Lets hope the ombudsman sees this in a new light.

    I don't think he's going to understand the issues on the new matter either, he will see it a broker is a broker lol, but the main thing is the connection to Hamilton, but it baffles me that he would not already know this anyway with already being in touch with Endeavour.
    Bet there was no paperwork from them though, just verbal contacts!
    Will take a look at LB when I get a min later. x

    Chased the Adjudicator up, as we felt we need to get on with this matter for as soon as possible, postie been and gone and nothing in the post from him today, so asked him if a letter had been sent yet and said we do have more info to send if necessary.
    So basically he more or less said he agrees with HFC and with not being under jurisdiction anyway, but said to forward more info in light of what we told him, so any help with this will be fab, thank you.
    Do you think I should go for the timescale he have given until 19th July or just get on and send all the info soon.
    Think I need to explain the issues of this case as well.

    It is pointless for me to write a opinion on this case for you to then again give me more documentation that I have to review and possibly do another opinion. It is important to say at this stage that following discussions with the HFC, I am still satisfied as before that they are not responsible for the sale of your policy and that it was sold by Click Finance. My view was going to detail exactly what was said to me by HFC and inform you that I am of the opinion your case is not within the jurisdiction of this service.

    However as expressed above it is not reasonable to send this letter to you without receiving all your information. Therefore can you send me any new evidence you have including the below. As I need all the information to fairly adjudicate this case. If you want some more time to conduct your own investigation that is fine, please let me know, as I do not want to review the below and be in the position to write an opinion and then you come back with more evidence.

    If you are sending the below evidence to me shortly then please indicate if this is all you wish for me to look out or if you want more time to conduct further investigations and I will allow till 19 July 2011 for you to send everything to me.

    I have a comment on what he will be doing with all the information. He will probably use it to make all firms aware to get their paperwork in order before there are a flood of complaints of this kind. My paranoia says that FOS are working with the firms and certainly not for the consumer. They have hit their target of "look at us, we fight for what is right proper and fair" and had their limelight in the media and now its back to business as usual. Hand in hand with the mouths that feed them.

    You would think we had the right to know what they are doing with all the info (our info). If we know what they're looking into then we know what to look for in evidence if required, so they are not making it any easier for themselves or even us really.
    But Yes that sounds about right Marshallka, they will probably use it in case of any other similar cases of this kind.

    I'm rather stunned to be honest, and brought up the word "contradicts" :eek:, I told him the point is the lead/link to the underwriter. And with so many involved its confusing, and despite that we stopped him in his tracks before he decided to do that letter of the HFC decision, I don't think he can be bothered!

    I spoke my mind anyway, sent him an email back.

    Di, they are just mincing your words. You were told that Click sold the PPI and so pursued them on it BUT you only went on their word and it was over the telephone that it was sold on behalf of Click/ENdeavour...... its confusing how they do sell PPI and we all know that. In fact the adjudicator should be able to make one of them responsible even if Click did make the sale. It sounds like your adjudicator is having a court case. YOU were missold PPI and someone is responsible. All 3 were making money from it and all 3 working together.

    It is like ours with FIrstplus. We were told that Freedom Finance/Bespoke Finance sold it but we have no recollection of this but then went to pursue them because it was what we were told.

    I remember when we received the agreement that PPI was typed in and it was FIrstplus that we then spoke to about it before signing and sending back the agreement. It was then that this was sold to us conditional to the loan as they said we had to have it and it was a savings scheme. We apparently applied for the loan via a teletext add they said, (yeah right) and we applied without PPI (which the application says) but it was added after applying BY FIRSTPLUS. In fact the broker only received commission on the actual LOAN and nothing on the PPI side of it so it seems as the transcripts they sent to me said a commission payment which was 5% of only the loan. I KNOW that no broker was involved in our sale (although the unregulated and untouchable broker will always admit to it!! HA HA) just because they know you cannot get it through to FOS.

    Its the same as yours, you know who actually made the sale of it now (you only listened to what you were told and first pursued Click) only because of the paperwork and the recollection of the phone call but one of them did and you only went on what you were told. They are just trying to wriggle out of it and pass the buck over.

    They should not make it so difficult for consumers to know who sold what. In fact any adjudicator would be able to get hold of information that you could not so again, there is something going on.
