My Ebay Nightmare - Please Help

hi,

i know this may irritate alot of people but i sold 3 nintendo wii's on ebay. i am only doing it as i have just bought a flat and really need some extra cash. i know i am a horrible person :(

basically this is what has happened... i listed 3 auctions but when i logged on to see how they were finishing somehow 4 auctions were listed and i am positive i only listed 3, and all at one day auctions.

Anyway when i listed the first one a guy emailed me and phoned me to say he would fly to scotland, meet me and buy a wii this morning, so that meant one of the auctions was void... but i was under the opinion he would ensure he won the auction even tho he was flying up and essentially buying the item before the auction would end this afternoon. However this never happened, and it sold and was paid for so out of the 4 that were on ebay i only had 2 to sell.

I only realised the one extra auction had been listed when i came home today, and i was unable to cancel it... so i started cancelling bids frantically to try and end the auction with no bids to it... anyway this was impossible as tens of people were biddin on it at once! so it sold for a fairly low price due to me cancelling bids. I then sent the invoice but told the person not to pay and gave my explanation and apologies. but she will not stand for it. she is demanding a wii, but i dont have one to give her!

so out of the 4 auctions on ebay i only had 2 to sell and on the other auction- i knew i couldnt cancel the listing due to it finishing in the hour so i asked a friend to bid a ludicrously high bid so they won it and i would mutally cancel the transaction with him. so the woman that was demanding the wii bids like £1000 on my auction that i asked my mate to make sure he won and she goes and wins it!

now she is saying she wants them both... but she obviously wont pay £908 for a wii, so i sent her a mutual cancellation for that one and she has rejected it! and she rejected the first mutual cancellation on the first auction she won!

i really really dont know what to do. worried about her threat of legal action and worried about the ebay fees i am going to be charged.

can anyone help or advise me on what i should do?

    Oh dear, got yourself into a bit of a pickle didn't you?
    I won't tell you off for breaking about a million Ebay rules, or even rules we like to abide by.
    The guy flying up - he hasn't bought anything from you, so you are under no obligation to sell. Therefore sell the two you have to the woman who won them. Her low win and high win will even out surely to give you enough cash for Xmas.
    In the future, run your auctions more carefully!

    Wow , What a mess!

    You should NOT have sent a mutal cancelllation because she has refused and now ebay will not give the final fee(s) back.

    You are still able to proceed with the sale..
    Insist its the price she has to pay (remember its a binding contract)
    and any sensible person won't pay £900....

    Then put a dispute for payment not received to claim your fees back.

    *****Before you do this make sure the you can still file a dispute for non payment ( because at this stage it may not be available)*******



    Otherwise ,I would contact ebay and ask them to look into the ridiculous amount bidded ...........

    a mate says cos i did a mutual cancellation i wont be able to claim ebay fees back if she doesnt pay up.

    I've looked down the list of completed auctions, is yours the one at £1220 with the winning bidder's name - scrueyou1987?

    If so, it doesn't look like a genuine buyer.

    If not, looks like someone else has a problem too.

    Invoice her, wait for payment to arrive. Finger crossed she's not stupid enough to pay. Just out of curiosity how much did the cheaper one go for?
    As the post above me says, you're not obliged to sell to the guy who wants to fly up. Additionally I highly doubt anyone will take legal action against you - most of the rules & regs are there to scare you into doing what you should do. Wait & see if she pays, then take it from there - to be honest it sounds like you don't need to worry & she's just trying to put the wind up you because she knows she can.

    Very Strange...... Somethings fishy going on

    Just to clarify , you only get one go at reclaiming your fees on each auction, so if the buyer has already declined to co operate with a mutual reclaim you can't now do a full NPB so the buyer will not get a strike nor will you get your FVFs back on that auction.

    This is a real mess, you may get a lot of flak on this especially if you let any indication of shill bidding be noticed.

    cheaper one went for 322. and the one she bidded up high was 908.

    how much will i get charged in fees ?

    really gutted i sent her mutual cancellation thing.

    go to preferences in myebay & view your account - it'll give you the exact amount.
    TBH it sounds like they wont pay up if it's two for 1.2K :)
