Most people would probably think that consumer law means The Sale of Goods Act , I think of it that way .0 -

Just got this bull from Customer.Relations@woolworths.co.uk
Thank you for your e-mail.
Woolworths endeavours to ensure that all pricing information on its website is accurate. However, on very rare occasions, errors do occur.
Due to an isolated technical problem, Woolworths can confirm that a pricing error occurred on a small number of TVs. The LCD TVs, normally priced at over a £1,000, were priced at just over £100 for a short period of time.
The terms and conditions on our website state that we will contact customers within 24 hours if a pricing or order error occurs.
Woolworths has already contacted customers that placed orders to inform them of the error and to apologise for the inconvenience.

Hi, I just got that as well."Holding On For Dear Life" - read my true story of when my fiance suffered a stroke exactly 3 weeks before our wedding.

Tallyho wrote:...Its a very grey area all this taking money & NOT fulfilling . The T&C's seem to totally contradict the Sale of Goods Act which I think states once the money has been taken then the retailer MUST supply . I'm not a consumer lawyer so I would like to be educated on this point if necessary .
Ref: the Dell W2600 fiasco from last November. IIRC, they who had cash taken but with no goods supplied were granted 'loss of bargain' status and some were refunded plus the difference need to purchase an equvalent set (i.e., £348 paid for the Dell, goods not supplied, refunded £600 for an equivalent).

the last line is interesting
There are a number of things a trader is not allowed to do when they sell you goods. These include:
* make a written statement that you have no legal rights when you buy goods
* make a false description about goods
* sell dangerous or unsafe goods
* try to charge for goods sent that you didn't order
* sell short measure or short weight
* give a misleading price, either in writing or verbally.Don't take life too seriously, no one gets out alive0 -

There is more to it than just the Sale of Goods Act. Other laws that apply include the Distatance Selling Regulations, UCTA, common law contract and the law of mistake.
In this one, and with most other internet pricing mistakes, the law of mistake and basic contract law are crucial."An eye for an eye leaves the whole world blind" - Mahatma Gandhi0 -
of course, can company can charge before despatch, but i dont think thats the policy of woolies - they *usually* charge when it is ready. and they make mistakes as with your case and today's tv fiasco.deanos wrote:Yes you can be charged before despatch, Woolies charged me straight away for a order i placed even tho it took 3 weeks to arrive0
