Oops - I mean that their skilled disability professionals would be burdened by reading unneeded material.
One vital point.
A GPs report saying 'x is in my opinion totally incapable of work' - is really problematic - it doesn't answer to the criteria.
If the OP has just got the report, I don't see that it's likely that ESA was applied for after the 28th of march.
Look at http://www.dwp.gov.uk/publications/specialist-guides/decision-makers-guide/ - specifically chapter 42.
You should read all of this - but especially page 71 and on - these are the tests that the decision makers should be following.
Do you believe that an impartial person, with knowledge of your condition, would score you at over 15 points total?
If so, then see if you can find evidence for this.
Some of these tests are really easy.
'Cannot hear at all' (15 points) - you are likley to have no problems getting a doctor to certify this.
Some are hard.
'The claimant frequently misinterprets verbal or non-verbal language, causing them severe distress' (6 points) - have you discussed this with your doctor? If not - they may well be very unlikely to mention anything relevant to this descriptor in their report.0 -
I have to congratulate you and admire you carolannie for your ability to fight their decision. By the time I had had my assessment I was back on suicidal watch for 3 weeks :-( and that was before I got the results! So well done for being strong enough to fight ATOS.
You mentioned in one of your posts that you are a risk to yourself or others? All you need to do is get the medical person who stated that to put it in writing for you stating the reasons why! You should have been placed in the support group as I was.
I even tried to have the work related interviews but I only managed the 1st one and was told I am not yet ready for that but was welcome to contact jsp in the future when I felt my depression had improved!
It seems you was unlucky with the assessor? When I went for my assessment they have some records of mine there, overdoses, hospitalised due to overdoses etc.
I do believe (as a long term sufferer) it is way too easy to fall into a trap of 'I can't do this, 'or can't do that'.
I resigned from 18 months (I worked with children in an educational setting) I was made to feel useless, worthless and high risk! In the end it just made my illness worse.
I have no intentions of going back into that career, as you will know, things have just got so bad in that sector that it just isn't worth the stress factors that could bring on another bout of depression. I still don't know what work I will go into when fit for work again, but I do know it won't be a stressful position as I don't want to end up off work again with mental health problems!

I also have ASD and had bouts of "unhappyness", I think people nowadays focus too much on what they CAN'T DO not what they CAN DO! Also the OP has not got a proper diagnosis.
The web seems to be full people patting each other on the back and saying "Ahhh Their Their" let the forum shower you with symphony and people THINK they are ill when all they need is a direction. getting a job or volunteering is a good start.

I suffer ASD and was unemployed for 18 months and found it hard to find a understanding employer (ASDA!!) as I can have moments and have problems with interviews. I never thought of claming anything other than JSA there was days when I never wanted to get out of bed! I found keeping busy and looking for work cleaning the house, cooking dinner stuff like that.
Get a job it is part of the road to recovery! Too many people are using mental illness and back pain to sit at home and feel sorry for themself and expect others to pay.
In most cases it isn't a case of don't want to but you can't. True depression can be very debilitating.
I spend many a day using my energy just to try and force myself to do things......fail......then feel even worse for failing! This in return will then be an opening for the demons to invite their mate anxiety to give me a good beating too!
Other days I can force myself to do things around the house, this makes me feel on a high for achieving such small task.
Are you sure you have ever suffered depression? I think you might be mixing it up with 'fed up/can't be bothered, sad feelings!

People have made this very personal against me, I and others think alot of people abuse the system and confuse having a bad days with depression. If I had nothing to do all day and layed around in bed all day feeling sorry for myself, watching TV, Looking on facebook and posting on forums I think I would end up depressed. I think having something to do and having a purpose is good for you and getting a kick back into looking for work is something that some people need!
Come back and say the above again if you ever do suffer from depression, I hope you never do have to experience it.
Do people try and fake it? Probably so, but that doesn't give anyone on a forum the right to accuse someone of faking it. If You search my name on her for instance, you will see some days I'm making lots of posts, other times I don't post for days! I agree there are many diffrent levels of illness, example I am a high functioning autistic, But I see life in a very polarized way my wife sees this as a blessing sometimes. But I still think there is too much of "I CAN'T DO IT" instead of "I'M GONNA DO THIS"
People feel the appeals process is going to be abused like it is in immgration cases. People are fed up with working in jobs they hate coming home after a 12 hour shift to see their neighbor has spent all day at home in the garden sitting in the sun when there appears to be little to nothing wrong with them. I can't see why people get so uptight when the the tax payer asks how bad you are and asks for evidence? This is a rushed system to look good in the press and hide the true facts of what is going on. If you are expecting to live for free you should expect to jump through a few hoops (unless you have a bad back) and prove you are unwell. If we get rid of all the slackers there will be plenty of money around to look after the people who REALY NEED FULL SUPPORT.
TBF If you can go shopping, mow the lawn, tidy a house, have a chat, make a cup of tea or drive you can work or volunteer doing some or all of the above. There are loads of lonely elderly people who would love a chat once or twice a week.

You also have to remember that not all disabilities are visable to your neighbours who think you may have been sat on your bum all day doing nothing.0
