The problem here is that the 7 day refund for online is something they are forced to do by law and they have no choice over the matter. It's glossed up by them making out they are doing you favour in the T&C's

I disagree because it's all carefully packaged up in the DSR part of their conditions - so they'll just say they give it to you as you can't see it in the shop. In the shop you could have tested the product so we can't replace just because you decide when you get home you don't like it.
I'll be interested to hear how the OP gets on. Maybe he'll get someone who's got up on a good day, but if they're told to stick to policy, there's nothing anyone really can do.0 -
How does the OP know or mean by the phone not suiting

He/She must have opened and turned the phone on or had a look to know they did not like it.
And regardless - most retailers will not refund for mobile phones unless there is a fault when bought in high street.
Blaming t-mobile for not understanding the law and t&c of purchase seems futile.

So I understand that to mean it was purchased as a gift for his/her partner and it seems there was a better phone that had also been given as gift making the Blackberry redundantI recently treated my partner to a new Blackberry Curve 9300. As a gift you often take pot luck as to its suitability. The phone did not suit and indeed it was not the only phone received as a gift.
I don't think anyone is blaming T-Mobile for not understanding T&C's because we don't know what the shop T&C's are ???Blaming t-mobile for not understanding the law and t&c of purchase seems futile
I fully understand shops not giving refunds however I feel it would be a poor show if they do not offer to exchange for other goods or give credit notes ......if thats the case then you might as well cross off T-Mobile shops to do Christmas shopping :rotfl:It's not just about the money0 -

How can a phone be 'received' as a gift. Ok his girlfriend might have received as a gift from him but not from T-mobile. She turns around says - nah naff you are cheap. So she must have had a look at the phone.0 -

That is the OPs opinion - poor return policy - if he understands the legal position, he should understand the return policy of purchase. The unwillingness to help - that is his is word, we do not know what happened but if someone said - No we cannot refund or exchange, then that is because of the 'legal' position regarding the sale.0 -

Anyone can 'name a shame' here for poor (in their opinion) quality, CS, T&C etc.0 -
And bear in mind that a 'no questions asked' returns policy has a considerable cost to the retailer, which is passed on to all the other punters who do know what they want.No free lunch, and no free laptop
