As Andy says any compo would be to cover loss of some or all of your monthly package. That on top of ending up with a better phone, makes it sound Phones4U have played their part well. Even if you get no compo, you have a better phone, so doubt you could argue much.That said I would still seek compo if it applies to your situation.
You have not said (unless I missed it) why you ended up with a Bold when your Pearl became faulty. Did the manager/Phones4U explain why you could not have a Pearl or why they were offering you an upgrade?Here to learn and pass on my experiences.

Just done some digging of my own. This extract sums up what I found.
In terms of replacement phones, most providers will work on a like for like basis. Even if this is within warranty or if you have insurance. They do not HAVE to change the model of the phone, by law they are only responsible for providing you with a working phone. In certain circumstances you may be offered a different model. But it is not a statuary right that you are entitled to get one. Therefore you would be told in the event that you were having multiple issues, they may offer a different model. It is usually 3 or more same faults.
So that makes it sound like you either have to accept the new Bold, or a phone of the same spec etc as a Bold, the answer to this choice lies with Phones4U. If you do not want a Bold, your best option may be to ask for a "downgrade" to your original Pearl.
That extract also (like other sites I found) states that if you have a fault which keeps repeating itself, you will have a much stronger case after it happening 3 times. So you may have to accept the new Bold.

Silly question. Why doesnt the OP go to the service provider i.e. O2, Orange etc. I had a problem with my Bold when I first received it, it wouldnt pick up the wireless signal at home, one phone call to Orange tech team and they sorted it. The BB doesnt sound "faulty" it really sounds like a technical fault as opposed to being "broken".0
