i've been a passenger with him many times, he is a courteous and experienced driver. Driving along the motorway at 90 is of course over the speed limit....but i personally don't have an issue with that speed according to traffic and conditions. I also don't think sipping coffee from a cup is at all dangerous in the way that speaking on a mobile or reading from a map is.....

sounds like you shouldnt be allowed behind the wheel either.
I personally think the motorway limit is too low but there can be no excuse for driving with a coffee in his hand, its all the other drivers lives hes putting at risk not just yours and his.

Yes I am experienced driver who does 40k a year, I do put my foot down a little, but I don't do anywhere near 90mph and I certainly don't drink coffee while doing any driving, to say its not dangerous is frankly bizarre, and your friend is an accident in waiting!

Now your best bet is to pop over to www.pepipoo.com with this should he get a ticket, it must arrive within 14 days otherwise I believe it could be invalid.

How can you say that, when the cup is at his mouth his eyes are not on the road split second maybe but it only takes a split second to cause an accident.

Okay. So he's driving along at 90mph, enjoying his mochacino-frappuchini-latte when:

    a) he hits a puddle of diesel on the road and the car veers towards the central reservation
    b) the lorry/car he's overtaking has a tyre blow out and starts weaving all over the road
    c) his car has a tyre blowout
    d) he decides to change lanes

He needs razor-sharp reactions and full control of the vehicle to manage any of these situations, and without both hands on the wheel he simply doesn't have that. Not to mention that drinking something that could cause him injury if dropped (in such an emergency) is not particularly bright.

For those reasons he (and you) need to seriously reconsider whether his driving choices are the best approach ;)

So you've never changed a CD, retuned the radio, looked at the mrs while having a conversation whilst driving? Maybe turned round to give the kids a telling off? Really?

Get a grip people, it's easy to post sanctimonious crap on the internet as if you're the perfect driver.... take a good look at what you ALL do, day in day out!

With respects, drinking a coffee while doing 90mph past a speed camera, is not something most people do, and I did actually tell the OP to try pepipoo for this, but to be honest what excuse could he use if a ticket comes through the post, likely a court appearance if they have clocked everything.

...In other words, if my friend wasn't chased down, do you think he is ok....or can he expect a fine in the post?...
First off, and leaving aside the holier-than-thou claptrap, you can't get a fine in the post. Your "friend", if he is the registered keeper, should keep an eye on the post, as they must send him a NIP and s172 request within 14 days.

If he gets one of these, he then has 28 days to nominate who was driving. This may then result in a Conditional Offer of a Fixed Penalty, or a Court appearance - the only place he can get a fine.

If the device was a handheld LTi 20-20 (the most likely), the coffee drinking may be irrelevant, as these devices can only record speed accurately when pointed steadily at a fixed flat surface, such as the front number plate.

If the NIP arrives, start a new thread on Pepipoo and [STRIKE]you [/STRIKE] he will get the proper advice there.

Edit: I see you already have!

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Unfortunately the police do have an issue with it. Your opinion is irrelevant.
