So I am right in thinking that the mot is still valid and if the vehicle is sold the buyer can drive it away

No, because it is an unroadworthy car.

Everything I know with what is wrong will be marked on the auction.i do not intend to deceive anyone. My biggest concern is it has no MOT and that it can't be driven away. No one appears to know. On the database you can only search each test so one is valid to mid June and the latest one states fail.

An MOT test certificate has never guaranteed a vehicle to be defect free for a period of twelve months after the test. IANAL but I seem to recall the phrase used to be along the lines of being able to provide a valid test certificate for the vehicle. It's open to some interpretation and arguing of semantics as I see it. The certificate is perfectly valid, but the vehicle was found to have defects at a later test.

The best 'test' would be to use what the Police would use if it triggered an ANPR camera or attracted a tug. Follow the link in post 3 and see what the database says. It would very probably be the one the police would use at the roadside.

The other thing to consider is this, if you sell a known duff vehicle to someone - no matter how well you think you may be able to handle yourself - don't be surprised if the new buyer returns and teaches you some ''manners'' by way of a surprise visit ;-)

That is not the issue here. The OP was intending to knowingly sell a vehicle that had been declared as unroadworthy, without informing any prospective buyer. That is an offence.

I had no intention to deceive.I was enquiring about the MOT and also whether I was required to give the full in and outs if the mot.

As I mentioned in a previous post I'd still be inclined to get it through the test if you're going to sell it -- it'll be easier to sell and provided the bill's only a couple of hundred you should get that back and a bit more. People are much more likely to just look at the ticket if it's a full 13 months.

Do you have a reference for that with respect to a private seller?

    You mean things like misrepresentation?

"Is there anything wrong with it?"

    "No."

    "No."

That wasn't quite what you said.

    So, what is the offence?

If the fails were for dangerous or structural rust problems, then the current MOT is void.

Don't forget the MOT failure and advisory can be veiwed online...

Hi - if the car PASSED it's mot but had an advisory issued, will this website tell you what the advisory was? I bought a car which had a 12 month mot cert put on it but the garage said it had an advisory note about the seatbelt being frayed, but the advisory note isnt attached to the certificate. I just wanted to check on it.
