Selling car after failed MOT

I took my car for an MOT 4 weeks early to a council run MOT. It failed on 10 things, mainly rust which was 6 of the things and then minor things. If i want to sell the vehicle do i have to declare all the information i know tat it has failed on the MOT or can i just sell it stating that it has a month left on the MOT?

Obviously the problems will be highlighted with the rust etc

    Sure I've seen a notice to testers that if you have an MOT done early and the car fails, it voids any current MOT.
    Will check at work tomorrow

    It will be recorded against the vehicle on VOSAs web site

    I work at a council MOT station, but let my testers certification lapse a few years ago

    If the fails were for dangerous or structural rust problems, then the current MOT is void.

    Don't forget the MOT failure and advisory can be veiwed online...

    I spoke with the mechanic and he stated it was still valid until it ran out

    Offside door step Body or chassis has excessive corrosion, seriously affecting its strength within 30cm of the body mountings (6.1.3)
    Offside door pillar Body or chassis has excessive corrosion, seriously affecting its strength within 30cm of the body mountings (6.1.3)
    Nearside Front Lower Suspension arm synthetic bush deteriorated resulting in excessive movement (2.4.G.3)
    Nearside Front Anti-roll bar linkage has excessive play in a pin/bush (2.4.G.3)
    Offside Front Anti-roll bar linkage has excessive play in a pin/bush (2.4.G.3)


    These are things it has failed on, the current MOT runs out mid june

    can you give a more direct link to your statement above please, as far as i know the mot is still valid until the old cert runs out.

    Well the answer does not seem to be found on any of the government information about the MOT test, so we emailed VOSA with this question and this is their response:
    "An MOT certificate is valid until its expiry date. However if your vehicle fails a test before this date and you do not rectify the defects then you are driving an unroadworthy vehicle which is an offence."

    What is the offence, driving without a valid MOT or driving a vehicle unsafe to do so? In question if i get stopped by police and they notice the problems is that the offence, or is it the fact that i failed an MOT?

    I'm trying to find a legit quote, but it's a bit like wading thru mud the Road Traffic Act 1988...

    what I was thinking of was a breach of 101 construction and use,,which is driving a car which is a danger to other road users,,,IYKWIM :D

    The MOT is still valid, and it shows up as having an MOT, but will state something like "further test results are recorded for this vehicle"
    If you check the history the fail will be available, with all the details.
