Hi
I recieved a letter on the 03 May 2011 from a company called HFO services. The letter informed me of a debt with Barclaycard from some time ago. I did not remember having this debt at all. So i sent then the following email.
Dear Sir/Madam
I have today received a strange letter from yourselves in regards to above case number. The letter has my name and address on but is not for me as I do not or have not had a Barclaycard or account. This Letter mentions "as you have already been informed". As I have never received a letter from yourselves or Barclaycard this leads me to believe this is either your error or somebody is acting on my behalf. ( Identity Fraud). Would it be possible for you to inform me of which one this may be so i can contact the police or relevant authorities immediately.
Thank you for your help in this matter.
Kind regards
Stewart hall
My phone number was at the bottom of the letter. So next day i recieved a number of calls from a number i did not know. I ignored this until they rang for the 5th time then i answered. It was a lady ( i say the term lady very losely ) from HFO services. I said i have no knowledge of this debt and would like a original copy of the credit agreement. She that this was possible but would take time. she then said that yes this is my debt and it requires imediate payment or installments setting up. To which i responded i would rather wait till i have proof the debt is mine. She then told me my last two previous addresses and some personal details. So i said i didnt remember the debt so would really rather wait for proof as the amount (1436.65) was higher than i would have been able to get as credit at the time. She replied that this was with interest. I asked when the last contact with me was to which she said was Oct 2005. ( obviously the reason they are now chasing as its nearly 6 years ). Then i again stressed i cannot pay without proof! To which she then answered if i dont pay i will have a ccj against me in 3 days. (i know now this isnt possible) I really couldnt take the risk as ive worked so hard to be almost debt free a ccj would destroy me and my credit rating. I told her this and that it may affect my job if i have a ccj. To which she replied well if i receive no plan or payment NOWn then the ccj will be on your credit report in 3 days. I said i still dont agree its mine but couldnt take the risk. So like an idiot i set up payments of £72 for 12 months to wipe the debt. (this was after she removed all interest and charges. I know now this was the most stupid thing i could of done. I feel i was left with no choice and forced into this.
Is there anything i can now do??
Thanks for taking time to read my long post.

Start by sending the CCA request.
Edit
Sorry being blunt, but nipping out for a while. Can help you later tonight..Happiness, is a Kebab called Doner.....:heart2::heart2:0 -
Oh dear. Never ever pay debt without proof.
What exactly did you use to set up the payments? You need to get hold of your bank and cancel it NOW.
Otherwise they will swipe the whole £1436 if there is enough money and leave you nothing to live off next month.
If the last contact was October 2005, this debt would be statute barred in October 2011 if it is yours and you have now re-newed your liability for another 6 years.
More likely, if it is your debt, that the debt is already statute barred and you have just given HFO a fat profit, because they will have bought it for less than you have already paid.If you've have not made a mistake, you've made nothing0 -
Bear in mind that they can't add interest and charges, but that's another story.Happiness, is a Kebab called Doner.....:heart2::heart2:0

Was this a debit card or dd? If direct debit, then just cancel it.
If a card transaction, then call up your bank right now and tell them that you've lost your card.
Seriously - what were you thinking.
Never give your phone number out to spurious debt collectors.
And never, never set up payments for anything.
What they have told you is a complete pack of lies. It's true that there is one born every minute - that's what they are counting on!"One day I realised that when you are lying in your grave, it's no good saying, "I was too shy, too frightened."
Because by then you've blown your chances. That's it."0 -
Thanks for the reply.
I used my debit card. I knew as soon as id done it id made a BIG mistake. I take it theres no way out of it now even if I do cancel they will chase me for the money for 6 years?0 -

I will cancel card now. Thanks but what`s my next step? I really do know how stupid ive been I would normally be shocked by someone else doing what i have done. I was just so bothered about CCJ as i have one just about to leave my credit score and financially am now secure so i thought if by any slim chance this was true the house i am looking to buy would be out of the window. I bow my head in shame!!0

No they won't - you don't even think there is a debt.
Stick to your guns.
1. Cancel your card.
2. If they contact again don't speak to them/do anything until they have sent the credit agreement.
3. Once you have it, stay on here for advice."One day I realised that when you are lying in your grave, it's no good saying, "I was too shy, too frightened."
Because by then you've blown your chances. That's it."0 -
To get a CCJ, someone has to take you to court first! And then you have to lose. And then you have to not pay the money within a set time. It doesn't happy over night......or even in three days."One day I realised that when you are lying in your grave, it's no good saying, "I was too shy, too frightened."
