I am in the same position myself with the same underwriters only mine is for a D. Perkins card. Maybe we could keep each other posted as to our progress. I to am waiting on FICL contacting me re details of my complaint. However not being the patient type myself, I have the forms filled in ready to post tomorrow. I had ppi with the card from 1991 to 2003!!

Hi LynK, I think thats a great idea, I'm the same as you, I have all my letters ready to go, I will give them a few days then send them off if I haven't heard anything.

Would be interesting to see if anyone else on here has had any success claiming back from Financial Insurance Company Limited ?

    I will keep you posted

    Hi!

Can I join your gang please!

I got my letter back from Santander re: Debenhams Card taken out 04/03/96. They have confirmed they have been unable to retrieve a copy of the Credit Agreement but have assured me that the PPI was only added because I agreed to it!!!!! and I had an opportunity to change my mind as once I had elected to take it out a policy summary and document were mailed to me. I don't remember this and even if I had I thought at the time (before knowing about PPI mis-selling) PPI was part & parcel of obtaining credit!!!
The letter goes on to say that they did not record the sales process so have no way of knowing what took place in store but I had the opportunity to call within 30 days to remove the insurance. It goes on to say I could have contacted them at any time to remove the insurance. Why would I have contacted 'them' when 'they' didn't own these cards at any time I had the card.

So where do I go from here, please? Do I need to contact FOS or should I just put the complaint into the insurance company mentioned above (at the address above?).

Just waiting for the same letter back from Santander re: Laura Ashley Account (10% off your purchases seemed such a good idea at the time???!!!:o)

BTW,has anyone heard of a result from claiming against the insurance company?

    Hi Mumofjanda,

Your letter from Santander and its reasons / excuses was exactly the same as the one I received, more or less word for word. I contacted the FOS and they responded saying that at the time the business I was complaining about wasnt governed by them. They did tell me to contact them with details of the underwriter of the policy and if they were covered by the FOS I may have a case against them. I have received a letter back from the FOS to say they have been in touch with Financial Insurance Company Limited to let them know I will be complaining against them (they even provided an address and contact name to whom I should complain to)

So now I am sending off the PPI complaint questionnaire to Financial Insurance company limited. Once they have this they have 8 weeks to respond. If Im not happy with the outcome the FOS have told me to contact them again.

    Hope this helps !

    That's a great help thanks!!

Is it possible you could let me have the name and address of the person who you are going to address the complaint to or should I contact FOS first, myself?

Are you sending the original FOS questionaire or do you need to send something different this time?

    Thanks!

I have left the address in work, I will post it up here for you in the morning. You can also appeal to th FLA (I have) although going by posts on here it would appear to be pretty useless!

In 1998, the GISC code did not exist so intermediaries, who would be deemed responsible for the sale (whether or not it was missold) would not be covered by FOS unless they were members of the banking/insurance/building societies ombudsman scheme at the time.

Therefore, I think you will find you will be unable to pursue a successful complaint, I'm afraid.
Then why do FOS waste peoples time when they know of the dates that consumers took out their card/loan? Its so annoying, in fact its like they are just gathering information for some reason by asking consumers to do this KNOWING (if what you say is true and its ONLY GISC members whereby the Ombubdsman can step in this route) that they have no chance of getting the complaint through to FOS.

    Thanks for this!

Did you send the same questionaire that you sent to Santander or do we have to send something different/additional?

This one is really annoying me. Millions of accounts must have been opened with the likes of Debenhams, Top Man,Dot Perkins etc. without even a mention of PPI addition, at the time of sale! (I know I had 3 of them!!!)
So don't want them to get away with it!!! but looks like they might.
Someone on the other thread has reported a success with Debenhams. We need to find out more!!
