    I thought the police response was fairly good, apart from the 2 PCs who haven't recorded it yet. What makes you say that?

    Also am I supposed to do anything to make a record of my shoulder hurting? I'm going to ring more than in the morning to ask them what they're going to do about everything. My bike needs fixing tomorrow really so I'll get some better pictures of it.

    He might be guilty of failing to report the collision but there is little chance of him being found guilty of dangerous driving.

    The fact you are being sent a form rather than a police officer taking a statement from you shows how serious they think it is.:(

    Seems to me you are doing all the chasing, and they haven't done an awful lot.

    Hope I'm wrong about that, but the police are very good at making people think something is being done when actually nothing is.

    Seeking medical help for your shoulder is the best way to make a record of the injury.

    Sitting around in casualty for hours will probably make you feel worse, so you could make an appointment to see your GP.

    If nothing else, you might be prescribed a few painkillers, and it will give you something to put down on the compo claim form, if you're minded to go that way.

    As soon as I mentioned 'injury' to the police yesterday they seem to have stepped up a gear. I'm going in to the station to give a statement later. The woman who called me to make the appointment wanted me to go to hospital for X-rays! I have no intention of wasting my time and more importantly NHS time on what I know is just a bruise, but I might go to the GP about it as you say. Or maybe the walk in centre.

    There does not have to be a collision for you to be entitled to bring a claim. I believe you have a good claim, the only issue would appear to be that you were filtering past stationary / slow moving traffic and in such cases, there are often allegations of contributory negligence, that is, you contributed to the accident and should have a percentage of your damages deducted to reflect the degree of contributory negligence. Factors that will be considered include your speed and lines of sight.

    If the Police cannot trace the driver, your claim should be made to the Motor Insurers' Bureau under the Untraced Drivers Agreement. However, there is an excess of £300 for property damage, therefore, you won't recover the first £300 of your claim. For property damage claims alone, the time limit to submit a claim is 9 months from the date of the accident and 3 years if there is a personal injury claim.

    Whether you need to instruct a Solicitor (via the legal expense insurance (LEI) with your home insurance) depends on whether there are likely to be arguments on liability, how much your claim is worth and whether you have a personal injury claim. If you just have a property damage claim and there is no loss of no claims bonus though, you'd be better off going through your LEI.

    Any cuts or bruises, at the very least take photographs, (well get a mate to, so there is a witness).
    Any tears to your clothes?

    Driver is traceable and insured - no problem there Phil. Yes, I am going to sort some insurance! This is getting a bit ridiculous. Turns out I don't have legal cover on my home insurance but no matter - I shall sort it myself.

    I went to give a statement at the police station today - had a phone call early today requesting I do so. Luckily I was dealt with by a policeman who is a cyclist himself and said himself he is one of the few who follow procedure and 'do this properly'. He took my statement and the case will be referred to the traffic collision department, who will then send him himself round to the drivers house to 'give him a piece of my mind' and strongly suggest that he accepts liability. Otherwise it will go to court for fail to stop after an accident (failing to give insurance/deal with it properly is as good as this), not reporting to the police within 24 hrs and possibly careless driving. He also told me to go to my GP to make a record of my injuries, because interestingly an accident is not an accident unless a PERSON or VEHICLE is damaged, and a bike is not a vehicle for this. So I went to the walk in centre, just so they had it on file that I sought medical attention for my injuries. Early indications from more than are that he is not accepting liability, yet.

    Should I be careful in telling the internet at large all this now it is the subject of a police investigation?

    mikey I have a photo or two of my elbow and knee albeit not very clear. No my clothes seem fine actually.
